ENCROACHMENT AGREEMENT/ LICENSE FOR THE PRIVATE USE OF A CITY OF RAMSEY <br /> EASEMENT OR REAL ESTATE <br /> The City of Ramsey, Minnesota, a Minnesota Charter City, (hereinafter, "the City") holds <br /> in trust for the benefit of the Public, dedicated park land immediately adjacent to real <br /> estate legally identified as PIN: 27-32-25-24-0010, and legally described as Block 1, <br /> Lot 26 of Regency Pond as filed with the office of county recorder of Anoka County and <br /> currently owned in fee by Michael and Michelle Powers (hereinafter, "Licensees"). The <br /> address of that property is 6821 146t" Circle Northwest, Ramsey, Minnesota 55303. <br /> The City has determined that a fence owned by Licensees as well as children's play <br /> equipment have been placed on the aforementioned park land without permission and <br /> in a manner inconsistent with the public's right of use and enjoyment of that property. <br /> In lieu of exercising its right to immediately remove the fence equipment and any <br /> other encroachment, the City has determined that the best interest of the City would <br /> be best served to allow the encroachment of the fence and play equipment to continue <br /> until such time as Licensees remove said encroachments on their own accord or sell <br /> their property. <br /> As a condition for the granting of this license, the licensees agree to keep said fence <br /> in good repair and the property which it encompasses well maintained. Use of the <br /> encroachment area shall not significantly impede the utilization of the trail located on <br /> the easement. <br /> This license shall expire upon a determination by the City, in its sole discretion, that use <br /> of the park land by the public has made the continuation of this license a <br /> potential nuisance or hazard. In addition, this license shall be terminated upon the <br /> sale of the property or by the mutual agreement of the City and the Licensees. <br />
