FC CASE <br /> <br />LANDFILL ENVIRONMENTAL ATTORNEY <br /> By: James E. Norman, City Administrator <br /> <br />Background: <br /> <br />During a work session held on June 6, 2006, the City Council discussed the recent difficulties <br />staff has had with discussions with representatives from the Minnesota Pollution Control Agency <br />(PCA). The City is interested in land for underutilized property of the landfill site for purposes <br />of the Public Works facility and industrial uses. The PCA has been saying that it is <br />undetermined when the State would be willing to release property for sale. After a consultation <br />with the engineers of the Bolton & Menk finn, a recommendation was made to utilize the <br />services of a specialist in the environmental field. The City Council met with Daniel Colton of <br />the Leonard, Street and Deinard law firm who specializes in environmental issues and dealing <br />with the PCA. <br /> <br />Recommendation: <br /> <br />Staff is recommending entering into an agreement with Mr. Colton of Leonard, Street and <br />Deinard for a not to exceed amount of $5,000. The expenditure would be funded through the <br />consulting services of engineering. <br /> <br />Committee Action: <br /> <br />Motion to recommend the City Council utilize the services of Dan Colton of Leonard, Street and <br />Deinard, for environmental consulting services for a not-to-exceed amount of $5,000. <br /> <br />Reviewed by: <br /> <br />City Administrator <br />Director of Public Works <br />Finance Officer <br /> <br />FC: 06/27/06 <br /> <br /> <br />
