Community Development Director Tmdgeon explained Shade Tree Communities, LLC has <br />applied for final plat and site plan approval to develop a residential Planned Unit Development <br />(PUD) subdivision on the property generally located west of Potassium Street and east of <br />Nowthen Blvd (CR 5). The proposed subdivision will have 16 single-family lots and 26 <br />detached townhomes. The preliminary plat and site plan for Shadetree Cottages was approved <br />by City Council on June 14, 2005. Mr. Tmdgeon explained the subject property is 28 acres in <br />size and is currently zoned R-1 Single Family. City Code restricts density to three units per acre <br />or up to four units per acre through a PUD. Council will be reviewing the applicant's request to <br />rezone the property from R-1 to PUD subsequent to this case. The request for a rezoning relates <br />to the utilization of both single family and townhomes within the development, the use of <br />detached townhomes, and to address deviations from City Code related to setbacks, lot standards, <br />and street standards. The final plat is proposing to develop 16 single family lots and 26 single <br />unit detached townhome units for a net density of 2.75 units per acre. Single family lots are <br />permitted within the R-1 District and townhome units are permitted through processing a PUD. <br />Mr. Trudgeon reviewed the proposed deviations from City Code for the Shadetree Creek PUD. <br />He advised the final plat is proposing to gain access from Potassium Street and Radium Street; <br />157~ Avenue will be a 28-foot wide private street; Potassium. Street and Quicksilver Circle will <br />be 32-feet wide public streets; and the proposed private street width and public cul-de-sac length <br />will be addressed as part of the PUD rezoning. <br /> <br />Community Development Director Tmdgeon reviewed with the Council that a lot of the <br />discussion regarding the Shade Tree Cottages plat involved the improvement of Potassium <br />Street. The City has been maintaining Potassium Street on property that is owned by several <br />property owners. It has been determined by the City Attorney that the City has the ability to <br />continue to use this area as a public road since they have been maintaining it as mad for many <br />years. City Council has authorized the use of eminent domain to purchase additional land <br />needed for the use of Potassium Street. Staff and City representatives have been in contact with <br />the property owners affected by the Potassium Street project and a public purpose hearing for <br />proceeding will take place on June 23, 2006. Mr. Trudgeon stated on June 14, 2005 Council <br />took action to approve the preliminary plat contingent on the following items: <br /> <br /> 1. Compliance with City Staff Review Letter dated May 6, 2005. <br />2. The City having acquired marketable title to a permanent easement for public street <br /> and utility purposes over and across the east 46 feet of the northwest quarter of the <br /> northeast quarter, Section 23 Township 32 Range 25, Anoka County lying north of <br /> County State Aid Highway No. 5. <br />3.
