is to look for dedicated ~eenspace or land banking and consideration towards density <br />transitioning of perimeter properties. Councilmember Strommen requested clarification <br />regarding the requirements this outlot would fall under when it is subdivided in the <br />future. Community Development Director Trudgeon replied the outlot would fall under <br />the R-1 zoning requirements at the time it is developed. If there are not greenspace <br />requirements included in the R-I zoning it would not be required at that time. However, <br />one of the things that can be done is to state that any piece of land that originally was <br />stated as a cluster subdivision and will be developed under R-1 standards will need to <br />meet the R-1 standards, plus whatever cluster ordinance requirements are determined. <br />Councilmember Cook stated there is a density transitioning ordinance that works <br />throughout the City and goes by size lot to like size lot. There seems to be a feeling that <br />this transitioning is not occurring elsewhere in the City, but it is occurring all over the <br />City where sewer and water are coming up to lots that are 2 ½ acres, with higher density <br />next to lower density. This type of transition is new in this area, but is occurring all over <br />the City. Councilmember Pearson stated the issues he has heard with the residents relate <br />to open space and the management of septic systems..It would be beneficial for the <br />individual that spoke regarding the septic system management to the Council the other <br />night to speak with the residents as well. This cluster ordinance could be used as a <br />benefit and will provide greenspace. Basically the residents need to understand what is <br />going on. It appears that there will be a lot of houses built according to the ghost plat, but <br />there will not be any houses on the other side of Armstrong Boulevard until water and <br />sewer comes to the area. City Attorney Goodrich advised if the Council intends to adopt <br />the moratorium on cluster ordinances there should be discussion regarding how Case <br />Nos. 2 and 3 are distinguishable from the areas the Council would like to study further <br />under the moratorium. Councilmember Cook stated the subdivision that was denied two <br />weeks ago has a lot more issues than just the cul-de-sac, which is why it was denied. <br />There were issues and concerns addressed in the findings relating to public safety issues <br />as well as due to the access and egress out of that area, and the number of houses already <br />using that access. The subdivision would have been denied with or without the <br />moratorium. Th/s subdivision has done whatever the City has asked of it for preliminary <br />plat, which should be acknowledged: Councilmember Strommen noted these <br />applications should be compared with the moratorium and the issues that will be studied. <br />Councilmember Cook stated this developer has said he will honor the future ordinance <br />without all of the requirements being in place in the actual cluster ordinance. There was <br />a similar situation when the Council started considering ghost plats, and the developer of <br />Tiger Meadows honored that part of the ordinance without the requirement being in <br />place; that development was moved forward with the ghost platting that was going to be <br />required in the ordinance. The City should let the people that have put time in and are <br />willing to honor the spirit of the cluster ordinance move forward. City Attorney <br />Goodrich advised on March 28, the Council introduced the moratorium ordinance and <br />stated the need to study density transitioning standards, open space provisions, <br />calculation of density, and septic system submittal requirements in relation to clusters. If <br />the Council intends to adopt that moratorium tonight they need to identify those things <br />that do not need to be studied on either of these subdivisions that are presently being <br />contemplated. Mayor Gamec commented these applications require a certified individual <br />to manage the septic system.
