Utility Operating Agreement <br /> <br />WHEREAS, [established HOA] is the owner of the property legally described as <br />Oudot A, Prairie Meadow <br /> <br />WHEREAS, the [established HOA] is organized and exists for the benefit of the <br />owners of all properties located in the two subdivisions; and <br /> <br />WHEREAS, National Growth, LLC and Kelly Wolf and John Osborne are the <br />developers of Rum River Prairie and Kelly Acres, respectively; and <br /> <br />WHEREAS, The City of Ramsey has authorized the construction and maintenance of <br />a Alternative Wastewater Treatment System (hereinafter referred to as "System') on <br />0utlot A, Rum River Prairie for the benefit of all properties which will be constructed <br />in both Rum River Prairie and Kelly Acres; and <br /> <br />WHEREAS, The City of Ramsey requires the installation of all sewer and water pipes <br />within the development and the maintenance of these pipes during non-use; and <br /> <br />WHEREAS, The City of Ramsey requires the connection to municipal services of <br />sewer and water and payment of sewer and water trunk fees and access charges when <br />the systems become available to the subdivision, as determined by City Engineers; <br />and <br /> <br />WHEREAS, the parties hereto desire to reach an agreement on the construction and <br />continued maintenance of said System, water pipes, and the payment of sewer and <br />water trunk fees and to allocate the responsibility for such construction and <br />maintenance. <br /> <br />THEREFORE, in consideration of the premises, and all other good and valuable <br />consideration, the parties agree as follows: <br /> <br />-293- <br /> <br /> <br />
