Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />#00-10-269A <br /> <br />RESOLUTION AUTHORIZING ACQUISTION OF PERPETUAL AND TEMPORARY <br />EASEMENTS FOR THE CONSTRUCTION OF IMPROVEMENT PROJECT #99-67 <br />(MISSISSISSIPPI RIVER STORMWATER SUBDP,.AINAGE DISTRICT NO. 1) <br /> <br /> WHEREAS, the City finds it necessary and in the public interest to conslruct storm sewer to <br />provide for improved drainage in the Mississippi River Stormwater Subdrainge District No. 1; and <br /> <br /> WHEREAS, it is necessary to acquire certain perpetual and temporary easements over under <br />across certain real property within the City in order to provide property for the storm sewer <br />construction; and <br /> <br /> WHEREAS, the City has authority to acquire the real property for the public improvements by <br />eminent domain pursuant to Minn. Stat. Chapter 117; and <br /> <br /> WHEREAS, the City has the right to acquire the real p~operty prior to the filing cf an award by <br />the Court appointed Commissioners, pursuant to Minn. Stat. §117.001 and §11.7.042; and <br /> <br /> WHEREAS, the City finds and declares that it is in the public interest to acquire title to and <br />possession of the easements described herein prior to the filing of an award by the Court appointed <br />Commissioners; and <br /> <br /> WHEREAS, the property owners of the real property, over, under and across which the <br />easements are necessary which need to be acquired have been identified by the City as follows: <br /> <br />PIN <br />35-32-25-31-0022 <br />35-32-25-24-0001 <br />35-32-25-23-0006 <br />35-32-25-23-0004 <br /> <br />FEE OWNER <br />Ramsey Holdings, Inc. <br />Ernest Miller <br />Winslow Holasek <br />Hunter Investment, Inc. <br /> <br /> WHEREAS, the legal descriptions of the perpetual and temporary easements and all interested <br />persons are identified as to each parcel on attached Exhibit "A" (the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) In order to carry out the purposes and objectives described above it is necessary to acquire the <br /> Subject Property. <br /> <br />2) The acquisition of the Subject Property by exercise of eminent domain in the manner serves a <br /> public interest and is deemed to be necessary. <br /> <br />3) The City deems it necessary for the reasons set forth above to proceed without delay under Minn. <br /> Stat. §117.042 to pay to the owners or into court a sum of'money to serve as compensation to the <br /> owners of the Subject Property, which amount shall be equal to Petitioner's approved appraisal of <br /> value as determined by the City. <br /> <br /> -351- <br /> <br /> <br />
