Councilmember __ introduced the following resolution and moved for its adoption: <br /> RESOLUTION #06-06-XXX <br /> <br /> RESOLUTION APPROVING 3RD PARTIAL PAYMENT TO W.B. MILLER INC. FOR <br /> LP. #05-23 EBONY STREET IMPROVMENTS <br /> <br /> WHEREAS, the Kamsey City Council authorized the preparation of plans and <br /> specifications for the above referenced work on May 24, 2005; and <br /> <br /> WHEREAS, the Ramsey City Council approved the plans and specifications and the <br /> advertisement for bids for the above referenced work on July 12, 2005; and <br /> <br /> V~-IEREAS, bids were opened and tabulated according to law; and <br /> <br /> WHEREAS, on August 23, 2005, the Ramsey City Council adopted Resolution #05-05- <br /> 285 awarding the bid for I.P 05-23 Ebony Street to w.B. Miller, Inc. in the amount of <br /> $247,795.05; and <br /> <br /> WHEREAS, Change Order Nol was approved by City Council on increasing the current <br /> conu'act amount to $255,912.05; and <br /> <br /> WHEREAS, City Engineer, Steve Jankowski has inspected the completed work and <br /> recommends partial payment to W.B. Miller, Inc. the amount of $56,351.02. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the City Council hereby authorizes partial payment to W.B. Miller Inc. for <br /> Improvement Project #05-23 in the amount of $56,381.02. <br /> <br />2) That the City Council hereby accepts the project and authorizes the Mayor or City <br /> Administrator to sign the release form for this payment. <br /> <br />3) That the total amount of this payment is not included in resolutions approving payment of <br /> bills for the date of June 13, 2006. <br /> <br />4) That the City of Kamsey Finance Department will be provided a signed copy of this <br /> resolution. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> , and upon vote being taken thereon, the following voted in favor thereofi <br /> <br />and the following voted against the same: <br /> <br />RESOLUTION #06-06-XXX <br />Page 1 of 2 <br /> <br />-83- <br /> <br /> <br />
