Councilmember Cook introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #06-04-116 <br /> <br />RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL TO KELLY ACRES <br /> <br /> WHEREAS, John Osborne and Kelly Wolf, hereinafter referred to as "Developer", have <br />properly applied for preliminary plat approval on the following described property located in the <br />City of Ramsey: <br /> <br /> Lots 2 and 3, Block 1, TRANBY ADDITION, Anoka County, Minnesota <br /> <br /> (the "Subject Property") <br /> <br /> WHEREAS, on April 21, 2005, the Planning Commission reviewed the sketch plan for <br />Kelly Acres. <br /> <br /> WHEREAS, on February 5, 2006, the City of Ramsey received an application for a <br />preliminary plat for subdivision from the Developer; and <br /> <br /> WHEREAS, on March 3, 2006, the Planning Commission reviewed the application <br />materials, and recommended approval of the preliminary plat with the following contingencies: <br />MPCA approval of the common septic system, resolution of the lot size issues for the existing <br />homes (specific to Kelly Acres), completion of the traffic study, and City Council re- <br />consideration of the cluster ordinance. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />2) <br /> <br />That the Ramsey City Council hereby grants preliminary plat approval to Kelly Acres, <br />contingent upon 1) compliance with City Staff review letter dated February 28, 2006, <br />revised April 5, 2006, 2) obtaining approval from MPCA for the design and location of <br />the community septic system, 3) the City approving the Articles of Incorporation and <br />Declaration of Covenants for the Home Owner's Association at Final Plat, 4) the <br />Developer engaging the services of a professional management firm to manage the <br />community septic system, with a requirement that the management firm be approved by <br />the City, 5) the Developer entering into a Development Agreement as part of the Final <br />Plat approval that will address the payment of Sewer and Water Trunk and Access <br />charges and the responsible party for the maintenance and abandonment of the <br />community septic system. <br />That the Developer is herein advised to continue to the Final Plat stage. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Olson, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> <br />
