Councilmember Cook introduced the following resolution and moved for its adoption: RESOLUTION #06-04-116 RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL TO KELLY ACRES WHEREAS, John Osborne and Kelly Wolf, hereinafter referred to as "Developer", have properly applied for preliminary plat approval on the following described property located in the City of Ramsey: Lots 2 and 3, Block 1, TRANBY ADDITION, Anoka County, Minnesota (the "Subject Property") WHEREAS, on April 21, 2005, the Planning Commission reviewed the sketch plan for Kelly Acres. WHEREAS, on February 5, 2006, the City of Ramsey received an application for a preliminary plat for subdivision from the Developer; and WHEREAS, on March 3, 2006, the Planning Commission reviewed the application materials, and recommended approval of the preliminary plat with the following contingencies: MPCA approval of the common septic system, resolution of the lot size issues for the existing homes (specific to Kelly Acres), completion of the traffic study, and City Council re- consideration of the cluster ordinance. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) 2) That the Ramsey City Council hereby grants preliminary plat approval to Kelly Acres, contingent upon 1) compliance with City Staff review letter dated February 28, 2006, revised April 5, 2006, 2) obtaining approval from MPCA for the design and location of the community septic system, 3) the City approving the Articles of Incorporation and Declaration of Covenants for the Home Owner's Association at Final Plat, 4) the Developer engaging the services of a professional management firm to manage the community septic system, with a requirement that the management firm be approved by the City, 5) the Developer entering into a Development Agreement as part of the Final Plat approval that will address the payment of Sewer and Water Trunk and Access charges and the responsible party for the maintenance and abandonment of the community septic system. That the Developer is herein advised to continue to the Final Plat stage. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Olson, and upon vote being taken thereon, the following voted in favor thereof:
