CC Regular Session 6. 1. <br /> Meeting Date: 07/09/2024 <br /> By: Todd Larson, Community Development <br /> Information <br /> Title: <br /> Public Hearing: Adopt Resolution#24-167 Vacating a Drainage Easement at 15890 Xenon St.NW <br /> Purpose/Background: <br /> The plat of Nature View Addition was recorded in 1989. The plat included a large area designated as a drainage <br /> easement to protect the floodplain of Ditch 66 and the surrounding wetlands. <br /> In 1996, a new house was constructed on one of the lots. It was also constructed mostly within the drainage <br /> easement,though on high ground. The property files do not indicate why the house was constructed in this area. <br /> The current owners are in the process of selling the house and this encroachment is holding up the sale. The <br /> property owners have gone through the FEMA flood plan amendment process (LOMA-R)to determine that the <br /> area where the house was constructed is not in the floodplain. Therefore,the area is not needed for drainage <br /> purposes that the easement is providing. Once vacated, the owners are able to sell the house and the buyers are <br /> able to secure a mortgage on the property. <br /> Private utility companies were notified.
