Councilmember introduced the following resolution and moved for its adoption: <br /> RESOLUTION#24-167 <br /> RESOLUTION APPROVING VACATING A DRAINAGE EASEMENT <br /> AT 15890 XENON STREET NORTHWEST <br /> RECITALS <br /> WHEREAS, David M. Barnish and Sandra K. Tiffany are requesting a vacation of a portion of a <br /> platted drainage easement on their property legally described as: <br /> Parcel A(Abstract) <br /> That part of Lot 3, Block 3, Nature View Addition, Anoka County, Minnesota. lying <br /> Easterly of the following described line.- commencing at the Southwest corner of said <br /> Lot 3, thence South 89 degrees, 54 minutes, 20 seconds East along the southerly line <br /> of said Lot a distance of SO feet to the point of beginning of said line to be described, <br /> thence North 6 degrees, 0 minutes, 0 seconds East to a point on the Northeast line of <br /> said Lot, and there terminating. <br /> Together with: <br /> Parcel B (Torrens Certificate No. 89714) <br /> That part of Lot 3A, Block 3, NATURE VIEW ADDITION, lying Easterly of the <br /> following described line; Commencing at the Northwest corner of said Lot 3A; thence <br /> South 89 degrees 54 minutes 20 seconds East along the North line ofsaid lot a distance <br /> of 50.00 feet to the point of beginning of the line to be described; thence South 6 <br /> degrees 00 minutes 00 seconds West to a point on the Southwest line of said lot, and <br /> there terminating. <br /> Subject to the easements for drainage and utility purposes as shown on the plat, <br /> NATURE VIEW ADDITION,filed January 29, 1990 as Document Number 193314. <br /> Subject to an easement for County Ditch No. 3 as shown by the map of County Ditch <br /> No. 3 on file in the Office of the Anoka County Surveyor. <br /> WHEREAS, a public hearing pursuant to Section 106-260 (Easement Vacation) of the Ramsey <br /> City Code and Section 12.6 of the City Charter was held on July 9, 2024, and that said public hearing was <br /> properly advertised and that the minutes of said public hearing are available; <br /> WHEREAS, Lumen provided notice that there are no utilities in the easement; <br /> WHEREAS, the property owners have worked with FEMA on a Letter of Map Amendment <br /> showing that the area is not needed for drainage or floodplain purposes. <br /> FINDINGS OF FACT <br /> 1. That the easement vacation will not violate the intent and purpose of the Comprehensive Plan. <br /> 2. That the easement vacation is necessary to accomplish the intended use of a residential home. <br />
