Councilmember introduced the following resolution and moved for its adoption: <br /> RESOLUTION#24-176 <br /> RESOLUTION APPROVING VACATION OF ALL DRAINAGE AND UTILITY EASEMENTS <br /> ON 14280 AND 14350 AZURITE STREET NORTHWEST <br /> RECITALS <br /> WHEREAS, Diamond Graphics (the "Applicant"), is requesting the vacation of all drainage and <br /> utility easements, as described in Exhibit 1, on the properties generally known as 14350 and 14280 Azurite <br /> Street NW, and legally described as: <br /> Lots 1 & 2, Block 1, Sunfish Lake Business Park Fourth Addition, subject to easements of <br /> record,Anoka County,Minnesota <br /> (the"Subject Properties") <br /> WHEREAS, the Applicant has applied for approval of a Final Plat to combined the Subject <br /> Properties into a single,buildable lot to accommodate a proposed 68,000 square foot building addition; and <br /> WHEREAS, a public hearing pursuant to Section 106-260 (Easement Vacation) of the Ramsey <br /> City Code and Section 12.6 of the City Charter was held on July 9, 2024, and that said public hearing was <br /> properly advertised and that the minutes of said public hearing are available; and <br /> WHEREAS, Centerpoint Energy, Comcast, and Zayo have all provided notice that they have no <br /> facilities within the easements being vacated. <br /> FINDINGS OF FACT <br /> 1. That the easement vacation will not violate the intent and purpose of the Comprehensive Plan. <br /> 2. That the easement vacation is necessary to accomplish the intended use of a 68,000 square foot building <br /> addition. <br /> NOW THEREFORE,BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, <br /> ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> That the Ramsey City Council hereby approves vacating all existing drainage and utility easements on the <br /> Subject Properties, as shown on Exhibit 2, contingent upon recording of the final plat known as Bunker <br /> Lake Business Park Fifth Addition, which combines the Subject Properties into a single, buildable lot and <br /> re-dedicates drainage and utility easements where needed. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> , and upon vote being taken thereon, the following voted in favor thereof: <br /> and the following voted against the same: <br /> and the following abstained: <br /> and the following were absent: <br />
