CC Regular Session 6. 3. <br /> Meeting Date: 07/09/2024 <br /> Submitted For: Adam Martin, Community Development <br /> By: Adam Martin, Community Development <br /> Information <br /> Title: <br /> PUBLIC HEARING: Adopt Resolution#24-182 Vacating Part of a Drainage and Utility Easement at 7990 <br /> Sunwood Dr. NW; Case of Take 5 Oil Change <br /> Purpose/Background: <br /> The City has received a Land Use Application from DSGW Architects (the "Applicant") on behalf of Garage RE <br /> LLC, doing business as Take 5 Oil Change (the "Permittee") for an Easement Vacation to accommodate an 1,860 <br /> square foot commercial building at 7990 Sunwood Drive NW(the "Subject Property"). <br /> Notification: <br /> Staff attempted to notify property owners within 350 feet of the Subject Property, as reflected in the Anoka <br /> County Property Records, as well as the small utility companies, of the request for the vacation of part of an <br /> existing drainage and utility easement on the Subject Property and the Public Hearing to be held by the City <br /> Council. A notice of the Public Hearing was published in the Anoka County UnionHerald,the City's official <br /> newspaper. A proposed development sign was placed on the Subject Property. <br /> Observations/Alternatives: <br /> Project Overview <br /> The Applicant is proposing to construct an 1,860 square foot commercial building on the Subject Property to <br /> accommodate Take 5 Oil Change, a quick-service oil change business. A portion of the proposed building <br /> encroaches into a platted drainage and utility easement that is currently not needed. Thus, the Applicant has <br /> submitted a Land Use Application to vacate this portion of the drainage and utility easement. Staff notified all <br /> small utility companies regarding the requested Easement Vacation. To date, no responses have been received <br /> from any of these companies to state their approval or objection to the request. <br /> Additional Information <br /> The site plan was reviewed by Staff and Planning Commission alongside the Applicant's request for a <br /> Conditional Use Permit. All other site conditions and improvements were found to be in compliance with <br /> applicable City Code requirements. The Conditional Use Permit will be brought to City Council for review and <br /> approval on Tuesday, July 9th. <br /> Funding Source: <br /> All costs associated with this request are the Applicant's responsibility. <br /> Recommendation: <br /> Staff recommends approving the Easement Vacation. <br /> Action: <br /> Motion to adopt Resolution#24-182 Vacating Part of a Drainage and Utility Easement at 7990 Sunwood Dr.NW. <br /> Attachments <br />
