Councilmember introduced the following resolution and moved for its adoption: RESOLUTION#24-182 RESOLUTION APPROVING VACATION OF PART OF A DRAINAGE AND UTILITY EASEMENT ON 7990 SUNWOOD DRIVE NORTHWEST RECITALS WHEREAS, DSGW Architects (the "Applicant"), is requesting the vacation of a portion of a drainage and utility easement,as described in Exhibit 1,on the property generally known as 7990 Sunwood Drive NW, and legally described as: Lot 2, Block 1, COR Four,Anoka County, Minnesota (the"Subject Property") WHEREAS,the Applicant has applied for approval of a Conditional Use Permit to allow for Motor Fuel Sales, specifically for oil change operation, on the Subject Property within a proposed 1,860 square foot building proposed to be constructed partially in a platted drainage and utility easement; and WHEREAS, a public hearing pursuant to Section 106-260 (Easement Vacation) of the Ramsey City Code and Section 12.6 of the City Charter was held on July 9, 2024, and that said public hearing was properly advertised and that the minutes of said public hearing are available; and WHEREAS,no utility company has provided notice that they have facilities within the easements being vacated. FINDINGS OF FACT 1. That the easement vacation will not violate the intent and purpose of the Comprehensive Plan. 2. That the easement vacation is necessary to accomplish the intended use of an 1,860 square foot building. NOW THEREFORE,BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Ramsey City Council hereby approves vacating part of a drainage and utility easement on the Subject Properties, as shown on Exhibit 2. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent:
