Councilmember Howell introduced the following resolution and moved for its adoption: <br />RESOLUTION #24-176 <br />RESOLUTION APPROVING VACATION OF ALL DRAINAGE AND UTILITY <br />EASEMENTS ON 14280 AND 14350 AZURITE STREET NORTHWEST <br />RECITALS <br />WHEREAS, Diamond Graphics (the "Applicant"), is requesting the vacation of all <br />drainage and utility easements, as described in Exhibit 1, on the properties generally known as <br />14350 and 14280 Azurite Street NW, and legally described as: <br />Lots 1 & 2, Block 1, Sunfish Lake Business Park Fourth Addition, subject to easements <br />of record, Anoka County, Minnesota <br />(the "Subject Properties") <br />WHEREAS, the Applicant has applied for approval of a Final Plat to combined the Subject <br />Properties into a single, buildable lot to accommodate a proposed 68,000 square foot building <br />addition; and <br />WHEREAS, a public hearing pursuant to Section 106-260 (Easement Vacation) of the <br />Ramsey City Code and Section 12.6 of the City Charter was held on July 9, 2024, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are available; <br />and <br />WHEREAS, Centerpoint Energy, Comcast, and Zayo have all provided notice that they <br />have no facilities within the easements being vacated. <br />FINDINGS OF FACT <br />1. That the easement vacation will not violate the intent and purpose of the Comprehensive Plan. <br />2. That the easement vacation is necessary to accomplish the intended use of a 68,000 square foot <br />building addition. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby approves vacating all existing drainage and utility <br />easements on the Subject Properties, as shown on Exhibit 2, contingent upon recording of <br />the final plat known as Bunker Lake Business Park Fifth Addition, which combines the <br />Subject Properties into a single, buildable lot and re -dedicates drainage and utility <br />easements where needed. <br />
