Councilmember Howell introduced the following resolution and moved for its adoption: RESOLUTION #24-176 RESOLUTION APPROVING VACATION OF ALL DRAINAGE AND UTILITY EASEMENTS ON 14280 AND 14350 AZURITE STREET NORTHWEST RECITALS WHEREAS, Diamond Graphics (the "Applicant"), is requesting the vacation of all drainage and utility easements, as described in Exhibit 1, on the properties generally known as 14350 and 14280 Azurite Street NW, and legally described as: Lots 1 & 2, Block 1, Sunfish Lake Business Park Fourth Addition, subject to easements of record, Anoka County, Minnesota (the "Subject Properties") WHEREAS, the Applicant has applied for approval of a Final Plat to combined the Subject Properties into a single, buildable lot to accommodate a proposed 68,000 square foot building addition; and WHEREAS, a public hearing pursuant to Section 106-260 (Easement Vacation) of the Ramsey City Code and Section 12.6 of the City Charter was held on July 9, 2024, and that said public hearing was properly advertised and that the minutes of said public hearing are available; and WHEREAS, Centerpoint Energy, Comcast, and Zayo have all provided notice that they have no facilities within the easements being vacated. FINDINGS OF FACT 1. That the easement vacation will not violate the intent and purpose of the Comprehensive Plan. 2. That the easement vacation is necessary to accomplish the intended use of a 68,000 square foot building addition. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Ramsey City Council hereby approves vacating all existing drainage and utility easements on the Subject Properties, as shown on Exhibit 2, contingent upon recording of the final plat known as Bunker Lake Business Park Fifth Addition, which combines the Subject Properties into a single, buildable lot and re -dedicates drainage and utility easements where needed.
