Councilmember Specht introduced the following resolution and moved for its adoption: <br />RESOLUTION #24-182 <br />RESOLUTION APPROVING VACATION OF PART OF A DRAINAGE AND UTILITY <br />EASEMENT ON 7990 SUNWOOD DRIVE NORTHWEST <br />RECITALS <br />WHEREAS, DSGW Architects (the "Applicant"), is requesting the vacation of a portion <br />of a drainage and utility easement, as described in Exhibit 1, on the property generally known as <br />7990 Sunwood Drive NW, and legally described as: <br />Lot 2, Block 1, COR Four, Anoka County, Minnesota <br />(the "Subject Property") <br />WHEREAS, the Applicant has applied for approval of a Conditional Use Permit to allow <br />for Motor Fuel Sales, specifically for oil change operation, on the Subject Property within a <br />proposed 1,860 square foot building proposed to be constructed partially in a platted drainage and <br />utility easement; and <br />WHEREAS, a public hearing pursuant to Section 106-260 (Easement Vacation) of the <br />Ramsey City Code and Section 12.6 of the City Charter was held on July 9, 2024, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are available; <br />and <br />WHEREAS, no utility company has provided notice that they have facilities within the <br />easements being vacated. <br />FINDINGS OF FACT <br />1. That the easement vacation will not violate the intent and purpose of the Comprehensive Plan. <br />2. That the easement vacation is necessary to accomplish the intended use of an 1,860 square foot <br />building. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby approves vacating part of a drainage and utility <br />easement on the Subject Properties, as shown on Exhibit 2. <br />
