Councilmember Howell introduced the following resolution and moved for its adoption: <br />RESOLUTION #24-188 <br />RESOLUTION APPROVING VACATING DRAINAGE AND UTILITY EASEMENTS <br />RECITALS <br />WHEREAS, a. request has been made to the City of Ramsey to vacate two drainage <br />easements legally described as: <br />Easement 1 (Exhibit 1): <br />The permanent drainage easement, originally granted in document number <br />447984, office of the Registrar of Titles, Anoka County, Minnesota <br />Easement 2 (Exhibit 2): <br />That particular drainage and utility easement, originally dedicated on the <br />recorded plat of COR TWO, Anoka County, Minnesota, and now to he vacated, <br />which lies within Outlot A, said plat of COR TWO. <br />WHEREAS, a public hearing pursuant to Section 106-260 (Easement Vacation) of the <br />Ramsey City Code and Section 12.6 of the City Charter was held on July 23, 2024, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are available; <br />area; <br />WHEREAS, Lumen provided notice that there are utilities in a portion of the easement <br />WHEREAS, a temporary utility easement will be recorded to bridge the time between this <br />vacation and the next plat that will be recorded dedicating the necessary easement for Lumen's <br />facilities. <br />FINDINGS OF FACT <br />1. That the easement vacation will not violate the intent and purpose of the Comprehensive Plan. <br />2. That the easement vacation is necessary to accomplish the intended use of the property. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby grants vacating the above -described easements and <br />as shown on Exhibits 1 and 2. <br />
