o <br /> <br />That the records indicate that there was a lapse in use of the property during 1990. The <br />Permit Holder was notified that a 12 month lapse of use would cause the conditional use <br />permit to be voided. The Permit Holder failed .to respond to City Staff requests for proof <br />of continued use of the property until thirty-seven 37 days after the given deadline. <br /> <br />That on March 29, 1991, City Staff notified the Permit Holder that an amendment to the <br />conditional use permit was necessary because auto repair operations at the subject property <br />had expanded beyond the scope allowed under the terms of the conditional use permit. <br />Over the course of the next nine (9) months, the Permit Holder failed to respond to the <br />City's request for an application for an amended conditional use permit and consequently, a <br />public hearing to consider revocation of the permit was scheduled for January 28, 1992. <br /> <br />o <br /> <br />That on November 29, 1991, an inspection of the subject property noted violations of the <br />conditional use permit consisting of repair of vehicles not for sale on the property; <br />excessive number of vehicles on the site; vehicles on the site exceeding one ton gross <br />weight; outside storage of inventory, parts, tires, partially disassembled vehicles; illegal <br />signs. <br /> <br />That on January 13, 1992, a police incident report was filed regarding a car fire on the <br />subject property. The fire was the result of salvage activities, which activity is a violation <br />of the conditional use permit and City ordinances. <br /> <br />10. <br /> <br />That on January 28, 1992, the Ramsey City Council conducted a public hearing pursuant to <br />Section 9.03.04 of the Ramsey City Code and that said public hearing was properly <br />advertised and the minutes of said public hearing are hereby incorporated by reference. <br /> <br />11. <br /> <br />That over the course of the conditional use permit, the City has issued a minimum of <br />sixteen (16) letters to the Permit Holder regarding operations at the site. Of the t6 <br />transmittals, the records contain two written responses; one from the Permit Holder and <br />one from his legal representative. <br /> <br />12. <br /> <br />That the case file reflects that over the course of the conditional use permit, the City has on <br />several occasions attempted to cooperate with the Permit Holder to resolve problems at the <br />subject site; the Permit Holder, however, has not displayed that same cooperative nature. <br /> <br />13. <br /> <br />That on January 6, 1992, a letter was sent to Mr. Gerald Root advising him of this public <br />hearing and there was no response received from Mr. Root. <br /> <br />14. <br /> <br />That Mr. Gerald Root was not present at the public heating, but Mr. Stanley Browning <br />appeared at the public hearing and stated that he was present as Mr. Gerald Root's <br />representative. <br /> <br />The motion for' the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor James Gilberterson <br />Councilmember Sheila Beyer <br />Councihnember Gerald Zimmerman <br />Councilmember Kenneth Peterson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
