Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-05-107 <br /> <br />A RESOLUTION DECLARING TERMS OF INTERIM USE PERMIT TO <br />ESTABLISH AUTO REPAIR/TOWING SERVICES/NEW PARTS SALES AT <br />14600 NOWTHEN BLVD. N.W. (PIN 25-32-25-23-0006) BASED ON <br />FINDINGS OF FACT #0311 <br /> <br />No defined hazardous wastes shall be stored or handled at the facility unless the required <br />permits have been obtained from Anoka County Environmental Services and the City has <br />been provided a copy of same. Any disposal of automotive fluids shall be in accordance <br />with State Statutes and Minnesota Pollution Control Agency rules and regulations. <br /> <br />There shall be no salvage or junk yard activities conducted at the site or in conjunction with <br />the business. <br /> <br />0 <br /> <br />All outdoor storage of any inventory, parts, and equipment shall be confined to an area <br />measuring 25' x 45' at the rear of the principal building and within the semi-trailer on the <br />premises. Use of the semi-trailer as enclosed storage space shall cease effective 12:00 <br />midnight on September 27, 1992. <br /> <br />Any signs erected on the site shall be in accordance with the specifications of City Code for <br />business uses. <br /> <br />o <br /> <br />There shall be 25 off-sn'eet parking spaces provided to accommodate employees, customers <br />and vehicles awaiting repairs. No improvements shall be required for the off-street parking <br />area as a part of this temporary conditional use permit. <br /> <br />Hours of operation shall be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday; and <br />9:00 a.m. to 6:00 p.m. on Saturdays; no business operations shall be conducted on <br />Sundays. <br /> <br />The above ground storage of any automotive fluids shall comply with all applicable State, <br />County or local regulations. <br /> <br />The permittee shall be responsible for all City costs incurred in administering and enforcing <br />this conditional use permit. <br /> <br />o <br /> <br />The City Administrator, or his designee, shall have the right to inspect the premises for <br />compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br />10. <br /> <br />This interim use permit is issued pursuant to the authority granted to cities by <br />MSA462.3597. The term of this interim use pennit shall expire on May 27, 1993 or when <br />Mr. Stanely Browning ceases to occupy the property, whichever comes first. Mr. <br />Browning shall remove any and all materials, supplies and equipment relating to his <br />occupancy and use of the property and shall provide the City with a written list of those <br />items on the subject property that he is not responsible or liable for. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Peterson and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor James Gilbertson <br />Councilmember Kenneth Peterson <br />Councilmember Gerald Zimmerman <br />Councilmember Sheila Beyer <br />Councilmember Glen Hardin <br /> <br /> <br />
