Councilmember Zimmerman introduced the following resolution and moved for its adoption: RESOLUTION #92-05-107 A RESOLUTION DECLARING TERMS OF INTERIM USE PERMIT TO ESTABLISH AUTO REPAIR/TOWING SERVICES/NEW PARTS SALES AT 14600 NOWTHEN BLVD. N.W. (PIN 25-32-25-23-0006) BASED ON FINDINGS OF FACT #0311 No defined hazardous wastes shall be stored or handled at the facility unless the required permits have been obtained from Anoka County Environmental Services and the City has been provided a copy of same. Any disposal of automotive fluids shall be in accordance with State Statutes and Minnesota Pollution Control Agency rules and regulations. There shall be no salvage or junk yard activities conducted at the site or in conjunction with the business. 0 All outdoor storage of any inventory, parts, and equipment shall be confined to an area measuring 25' x 45' at the rear of the principal building and within the semi-trailer on the premises. Use of the semi-trailer as enclosed storage space shall cease effective 12:00 midnight on September 27, 1992. Any signs erected on the site shall be in accordance with the specifications of City Code for business uses. o There shall be 25 off-sn'eet parking spaces provided to accommodate employees, customers and vehicles awaiting repairs. No improvements shall be required for the off-street parking area as a part of this temporary conditional use permit. Hours of operation shall be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday; and 9:00 a.m. to 6:00 p.m. on Saturdays; no business operations shall be conducted on Sundays. The above ground storage of any automotive fluids shall comply with all applicable State, County or local regulations. The permittee shall be responsible for all City costs incurred in administering and enforcing this conditional use permit. o The City Administrator, or his designee, shall have the right to inspect the premises for compliance and safety purposes annually or at any time, upon reasonable request. 10. This interim use permit is issued pursuant to the authority granted to cities by MSA462.3597. The term of this interim use pennit shall expire on May 27, 1993 or when Mr. Stanely Browning ceases to occupy the property, whichever comes first. Mr. Browning shall remove any and all materials, supplies and equipment relating to his occupancy and use of the property and shall provide the City with a written list of those items on the subject property that he is not responsible or liable for. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Peterson and upon vote being taken thereon, the following voted in favor thereof: Mayor James Gilbertson Councilmember Kenneth Peterson Councilmember Gerald Zimmerman Councilmember Sheila Beyer Councilmember Glen Hardin
