Mayor Gilbertson moved the adoption of the following resolution: <br /> <br /> RESOLUTION #92-05-108 <br />A RESOLUTION ADOPTING THE FOLLOWING FINDINGS OF FACT #0312 <br /> RELATING TO A REQUEST BY NORTH SUBURBAN DEVELOPMENT <br />COMPANY, DOLORAS FLEISCHER AND ROBERT BERNSTROM TO REZONE <br />CERTAIN PROPERTY FROM R-1 URBAN RESIDENTIAL TO R-3 URBAN <br />RESIDENTIAL AND CERTAIN PROPERTY FROM R-3 URBAN RESIDENTIAL <br />TO R-1 URBAN RESIDENTIAL <br /> <br />o <br /> <br />North Suburban Development Company, Doloras Fleischer and Robert Bernstrom, <br />hereinafter referred to as "Applicants", have properly applied for a rezoning of certain <br />property from R-1 Urban Residential to R-3 Urban Residential and certain property from R- <br />3 Urban Residential to R-1 Urban Residential. <br /> <br />That the Applicants appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.03 of the Ramsey City Code on May 5, 1992 and that <br />said public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />That the property proposed to be rezoned from R-1 Urban Residential to R-3 Urban <br />Residential is legally desacribed as follows: <br /> <br />That part of the south 622.0 feet of the Southwest Quarter of the Northwest Quarter of <br />Section 25, Township 32, Range 25, Anoka County, Minnesota, lying west of the east <br />220.0 feet thereof and lying northeasterly of the northeasterly right-of-way line of County <br />State Aid Highway No. 5, as now laid out travelled; <br />(hereinafter referred to as Parcel A for discussion purposes) <br /> <br />and that property proposed to be rezoned from R-3 Urban Residential to R-1 Urban <br />Residential is legally described as follows: <br /> <br />The north 320 feet of the south 1386 feet of the east 220 feet of the West Half of the <br />Northwest Quarter of Section 25, Township 32, Range 25, Anoka County, Minnesota. <br />(hereinafter referred to as Parcel B for discussion purposes). <br /> <br />That Parcel B is currently zoned R-3 Urban Residential and is proposed to be acquired <br />from Robert Bemstrom and included in the plat of Fleischer's 2nd for development with <br />single family urban residential lots. <br /> <br />That Parcel A is currently zoned R-1 Urban Residential and is proposed to be rezoned to R- <br />3 Urban Residential and conveyed to Robert Bernstrom for combination with his exisitng R- <br />3 Urban Residential parcel in exchange for Parcel B. <br /> <br />That the subject parcels to be rezoned are in an area containing R-3 Urban Residential, R-1 <br />Urban Residential and B-1 Business zonings. <br /> <br />That the proposed rezoning will not substantially impair the use or market value of any <br />surrounding property. <br /> <br />8. That the proposed rezoning will not change the essential character of the area. <br /> <br /> <br />
