Commissioner Deemer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-06-122 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE FROM <br />FRONT YARD SETBACK REQUIREMENTS TO LOT 7, BLOCK 3, AND LOT 6, <br />BLOCK 4, WINDEMERE WOODS, BASED ON FINDINGS OF FACT #0313 <br /> <br />On June 2, 1992, the Ramsey Board of Adjustment issued a variance from Section 9.20.12 of the <br />Ramsey City Code to permit the construction of dwelling units on Lot 7, Block 3, and Lot 6, <br />Block 4, Windemere Woods, that will encroach on the required front yard setback from the <br />dedicated Magnesium Street N.W. cul-de-sac. <br /> <br />This variance was issued pursuant to the authorization of Section 9.03.05 of the Ramsey City <br />Code. The terms of this variance are as follows: <br /> <br />The dwelling unit established on Lot 7, Block 3, Windemere Woods, shall not encroach on <br />the required front yard setback from the dedicated Magnesium Street cul-de-sac by more <br />than twenty-five (25) feet, or be closer than sixty-five (65) feet to the center of the road. <br /> <br />The dwelling unit established on Lot 6, Block 4, Windemere Woods, shall not encroach on <br />the required front yard setback from the dedicated Magnesium Street N.W. cul-de-sac by <br />more than fifteen (15) feet, or be closer than sixty-five (65) feet to the center of the road. <br /> <br />That the property owners of said parcels shall be responsible and liable for any landscaping <br />improvements or non-permanent structures established in the dedicated Magnesium Street <br />N.W. cul-de-sac right-of-way. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />Holland and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Terry Hendriksen <br />Commissioner Charles LaDue <br />Commissioner Paul Holland <br />Commissioner Michael Terry <br />Commissioner David Bawden <br />Commissioner Ben Deemer <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />Commissioner Bradley Thorud <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey Board of <br />Adjustment this the 2nd day of June, 1992. <br /> <br /> <br />
