Councilmember Hardin introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-07-169 <br /> <br />A RESOLUTION RESCINDING FINDINGS OF FACT #0298 AND ADOPTING <br />FINDINGS OF FACT #0316 IN RESPONSE TO AN APPEAL OF THE DENIAL <br />FOR A VARIANCE TO STREET FRONTAGE REQUIREMENTS ON PIN 10-32- <br />25-11-0001 <br /> <br />o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />That Tim and Brenda Smith, hereinafter referred to as "Applicant", have properly applied <br />for a Board of Adjustment variance from Chapter 9.02 (Street Frontage) on the property <br />generally known as PIN 10-32-25-11-0001. and legally described as follows: <br /> <br />That part of the Northeast quarter of the Northeast Quarter of Section 10, Township <br />32, Range 25, Anoka County, Minnesota, lying south of the north 471.50 feet <br />thereof, and lying west of the east 1100.00 feet thereof. <br /> <br />A public hearing was conducted by the Board of Adjustment pursuant to Chapter 9.03.05 <br />(Variances) of the Ramsey City Code on May 23, 1991 and that said public hearing was <br />properly advertised and that the minutes of said public heating are hereby incorporated as a <br />part of these findings by reference. Further, that the Applicant did appear before the Board <br />of Adjustment at its special meeting on May 23, 1991. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately 7.4 acres in <br />size. <br /> <br />That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That Chapter 9.02 of the Ramsey City Code states that in no case shall the street frontage in <br />the Rural area be less than 200 feet. <br /> <br />That a memo dated May 23, 1991 from Project Manager Jim Gromberg to Zoning <br />Administrator Sylvia Frolik is hereby incorporated by reference. <br /> <br />That the City has previously granted a variance for a similar request. <br /> <br />That the special conditions do not result from the actions of the Applicant. <br /> <br />That the granting of the variance will not grant the Applicant any special privilege that is <br />denied by this chapter to other owners of land in the same district. <br /> <br />That if granted, the variance will not be materially detrimental to the purposes of this <br />chapter or other property in the same zone. <br /> <br />That if granted, the variance will not increase the danger of fire, or endanger the public <br />safety, or substantially impair property values within the neighborhood. <br /> <br />That the Applicant has requested access to the subject property from the only location <br />where street frontage is available. <br /> <br />13. That on May 23, 1991, the Ramsey Board of Adjustment denied the request for a variance. <br /> <br /> <br />
