Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-08-191 <br /> <br />RESOLUTION APPROVING THE DIVISION OF LAND IN SECTION 23 BY A <br />METES AND BOUNDS DESCRIPTION <br /> <br /> WHEREAS, Mr. Walter Scroggins applied to the City of Ramsey for a division of land <br />by a metes and bounds description; and <br /> <br /> WHEREAS, Section 9.50.09 of the Ramsey City Code prohibits the division and <br />conveyance of land by metes and bounds description; and <br /> <br /> WHEREAS, Section 9.50.09 of the Ramsey City Code provides for City Council to <br />waive compliance when compliance will create an unnecessary hardship and failure to comply does <br />not interfere with the purposes of Chapter 9.50 (Subdivision); and <br /> <br /> WHEREAS, the subject property is approximately 48.9 acres in size and the applicant <br />desires to create a five acre homestead for himself and sell the remaining 43.9 acre parcel for future <br />development; and <br /> <br /> WHEREAS, the property legally described below is within the City's Urban Reserve <br />Area for which there is a ten acre minimum lot size: <br /> <br />That part of the north half of the Southwest Quarter of Section 23, Township 32, <br />Range 25, Anoka County, Minnesota, lying easterly of ANOKA COUNTY <br />HIGHWAY RIGHT-OF-WAY PLAT NO. 1 and lying southerly of the southerly fight- <br />of-way line of 153rd Avenue N.W. <br /> <br /> AND WHEREAS, the property legally described above is proposed to be included in the <br />Municipal Urban Service Area (MUSA) in the City of Ramsey's Comprehensive Plan Amendment <br />for 1993; and <br /> <br /> WHEREAS, it is anticipated that upon inclusion in the MUSA, the subject property will <br />be platted and developed in accordance with Chapter 9.50 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That Ramsey City Council approves the division of the above legally described property by <br />metes and bounds description as follows: <br /> <br />PROPOSED DESCRIPTION FOR PARCEL A: <br />That part of the north 578.67 feet, as measured at right angles of the north half of <br />the Southwest Quarter of Section 23, Township 32, Range 25, Anoka County, <br />Minnesota, lying easterly of ANOKA COUNTY HIGHWAY RIGHT-OF-WAY <br />PLAT NO. 1 and lying southerly of the southerly fight-of-way line of 153rd <br />Avenue N.W.
