17. <br /> <br />That the special conditions do not result from the actions of the Applicant. <br /> <br />That if granted, the variance will not allow the Applicant any special privilege that is denied <br />by the Zoning Chapter to other owners of land in the R-1 Rural Residential District. <br /> <br />18. That the Applicant is requesting the minimum variance to alleviate the hardship. <br /> <br />19. <br /> <br />That the variance, if granted, will not be materially detrimental to the purposes of the <br />Zoning Chapter or other property in the R-1 Rural Residential Disu'ict. <br /> <br />20. <br /> <br />That the variance will not increase the congestion of public streets or substantially impair <br />property values within the neighborhood. <br /> <br />21. <br /> <br />That in 1976, at the time Reilley Estates was platted, rear yard setbacks in the Rural District <br />were forty (40) feet and there were no ordinances in place establishing setbacks from the <br />Rum River. <br /> <br />22. <br /> <br />That the Applicant is requesting a variance to Ramsey's front yard setback in order to <br />respond to the preference of the Department of Natural Resources that variances be granted <br />to local setbacks versus the Scenic River setback and to save mature oak trees. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />Bawden and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Terry Hendriksen <br />Commissioner Ben Deemer <br />Commissioner Charles LaDue <br />Commissioner Michael Terry <br />Commissioner Bradley Thorud <br />Commissmner David Bawden <br />Commissioner Paul Holland <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br />whereupon said resolution declared duly adopted by the Ramsey Board of Adjustment this the 27th <br /> <br />day of August, 1992. <br /> <br />City Admifiistra or <br /> <br /> <br />
