Councilmember Beyer introduced the following resolution and moved for its adoption: RESOLUTION #92-09-240 RESOLUTION DISALLOWING PROPOSED IMPROVEMENT PROJECT #92-12 (BITUMINOUS SURFACING IMPROVEMENT OF 177TH AVENUE N.W. FROM ST. FRANCIS BLVD. N.W. TO ITS EASTERN TERMINUS) WHEREAS, a resolution of the City Council adopted the 29th day of June, 1992, fixed a date for a Council hearing on the proposed improvement of bituminous surfacing of 177th Avenue N.W. from St. Francis Blvd. N.W. (Improvement Project 4/92-12); and WHEREAS, the required sixty (60) days has elapsed following the public hearing; and WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given and the hearing was held thereon on the 14th day of July, 1992,at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, the Ramsey City Council has received a petition on the 14th day of July, 1992 signed by four property owners, representing 57 percent of the affected property owners, in opposition to the proposed project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1.) That the proposed Improvement Project 4/92-12 (bituminous surfacing for 177th Avenue N.W. from St. Francis Blvd. N.W. to its eastem terminus) is hereby disallowed as proposed in the Council resolution adopted the 29th day of June, 1992. 2) That proposed Improvement Project #92-12 may not be considered for a period of one year from the 14th day of July, 1992 as stated in Chapter 8 of the Ramsey City Charter. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Hardin and upon vote being taken thereon, the following voted in favor thereof: Mayor Gilbertson Councilmember Beyer Councilmember Hardin Councilmember Peterson Councilmember Zimmerman and the following voted against the same: None and the following abstained: None and the following were absent: None whereupon said resolution was declared duly passed and adopted by the Ramsey C.[~.
