Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-09-246 <br /> <br />A <br /> <br />RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT <br /> FOR AN OUTSIDE DISPLAY AREA <br /> ASSOCIATED WITH A MOTOR VEHICLE SALES LOT <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution #92-09-245, regarding <br />Findings of Fact #0321 for this use and herein approves a Conditional Use Permit subject to the <br />following conditions. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On September 22, 1992 a conditional use permit ("CUP") was issued by the City of Ramsey <br />("City") to Renae Kurak ("Permit Holder") to establish an outdoor display/sales area in the B-3 <br />Business District on approximately one-half acre of land generally known as 7665 Hwy. #10 <br />N.W. and legally described as follows: <br /> <br />That part of the Northeast Quarter of the Southwest Quarter of Section 28, Township 32, <br />Range 25, Anoka County, Minnesota, described as follows: Commencing at the <br />intersection of the west line of said Northeast Quarter of the Southwest Quarter with the <br />northerly right of way line of U.S. Highway No. 10; thence Southeasterly along said <br />northerly fight of way line a distance of 625.00 feet to the point of beginning of the land to <br />be described; thence continuing Southeasterly along said northerly right of way line a <br />distance of 464.63 feet, more or less, to a point thereon distant 386.98 feet northwesterly <br />of the intersection of said northerly right of way line with the east line of said Northeast <br />Quarter of the Southwest Quarter, thence northeasterly at fight angles to said northerly fight <br />of way line a distance of 216.17 feet, more or less, to the southerly line of the Burlington <br />Northern Railroad; thence northwesterly along said southerly line of said railroad a distance <br />of 476.91 feet, more or less, to a point thereon distant 691.80 feet southeasterly from its <br />intersection with said west line of ~aid Northeast Quarter of the Southwest Quarter; thence <br />southwesterly a distance of 195.39 feet, more or less, to the point of beginning. Subject to <br />easements of record, if any. <br /> <br />This permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this <br />permit are as follows: <br /> <br />This permit shall remain in effect so long as the conditions imposed herein are complied <br />with except that the permit cannot be transferred without the prior expressed approval of the <br />Ramsey City Council. <br /> <br />The subject property shall be permitted for an outdoor display/sales area that will <br />accommodate a maximum of twenty-seven (27) vehicles. <br /> <br />The outdoor display area shall maintain a seventeen and one-half (I7.5) foot setback from <br />the front property line of the subject property. <br /> <br />The subject property shall maintain a minimum of three (3) off-street customer parking <br />spaces, one of which will be designated for handicap use, and two (2) employee parking <br />spaces. <br /> <br /> <br />
