Commissioner Deemer inn'oduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-09-249 <br /> <br />A RESOLUTION GRANTING A VARIANCE, BASED ON FINDINGS OF FACT <br />#0323, TO CONSTRUCT AN ADDITION TO THE ATTACHED GARAGE THAT <br />WILL ENCROACH ON THE FRONT AND SIDE YARD SETBACK <br />REQUIREMENTS <br /> <br /> WHEREAS, on September 24, 1992, the Ramsey Board of Adjustment issued a variance <br />from Ramsey City Code Section 9.20.11 to Mr. Eugene Dubois allowing him to construct an <br />addition to the attached garage that will encroach on the required front and side yard setbacks on <br />the property generally known as 15030 Willemite Street N.W. and legally described as follows: <br /> <br />Lot 2, Block 4, Greenland Hills, Anoka County, Minnesota <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, that the <br />conditions of the variance shall be as follows: <br /> <br />This variance is perpetual in its duration so long as the conditions imposed herein are <br />complied with. <br /> <br />The proposed addition to the existing attached garage on the subject property shall not <br />encroach on the front yard setback requirement by more than ten (10) feet and the side yard <br />setback by more than seven (7) feet. <br /> <br />o <br /> <br />That the location, size and pertinent distances relating to the proposed snmcture shall be <br />shown on the certificate of survey and the site of construction shall be staked by a <br />registered surveyor to ensure compliance with the distances granted in this variance. <br /> <br />4 <br /> <br />No construction of the structure shall commence prior to the issuance of a building permit <br />by the Building Official. <br /> <br />That the property owner shall be responsible for all costs incurred by the City in <br />administering and enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />LaDue and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Terry Hendriksen <br />Commissioner Ben Deemer <br />Commissioner Charles LaDue <br />Commissioner Michael Terry <br />Commissioner Paul Holland <br />Commissioner Bradley Thorud <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br /> <br />
