Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-10-254 <br /> <br />RESOLUTION ELIMINATING RESTRICTIONS FROM ISSUING A BUILDING <br />PERMIT ON LOT 10, BLOCK 6, BARTHEL'S RUM RIVER ACRES 2ND <br />ADDITION <br /> <br /> WHEREAS, the City of Ramsey and the Developer of Barthel's Rum River Acres 2nd <br />Addition, entered into an agreement on October 12, 1979 which restricted the issuance of a <br />building permit on Lot 10, Block 6, Barthel's Rum River Acre Estates until such time as the City <br />could determine the lot buildable in accordance with its ordinances; and <br /> <br /> WHEREAS, at the time the agreement was entered into the flood plain elevations were <br />as yet unknown but were in the process of being established and were subsequently established <br />when the City received the final flood insurance study for the City prepared by the Department of <br />Housing and Urban Development later that year; and <br /> <br /> WHEREAS, the City Engineer has reviewed the Certificate of Survey for the proposed <br />building permit and has noted that the lowest floor elevation for the proposed structure is in <br />compliance with our flood plain zoning ordinance. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City hereby release the restriction on the issuance of a building permit for the <br />subject lot. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gilbertson <br />Councilmember Peterson <br />Councilmember Zimmerman <br />Councilmember Beyer <br />Councilmember Hardin <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br /> <br />the 13th day of October, 1992. <br /> <br />Administrator <br /> <br /> <br />
