Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION #92-10-254 RESOLUTION ELIMINATING RESTRICTIONS FROM ISSUING A BUILDING PERMIT ON LOT 10, BLOCK 6, BARTHEL'S RUM RIVER ACRES 2ND ADDITION WHEREAS, the City of Ramsey and the Developer of Barthel's Rum River Acres 2nd Addition, entered into an agreement on October 12, 1979 which restricted the issuance of a building permit on Lot 10, Block 6, Barthel's Rum River Acre Estates until such time as the City could determine the lot buildable in accordance with its ordinances; and WHEREAS, at the time the agreement was entered into the flood plain elevations were as yet unknown but were in the process of being established and were subsequently established when the City received the final flood insurance study for the City prepared by the Department of Housing and Urban Development later that year; and WHEREAS, the City Engineer has reviewed the Certificate of Survey for the proposed building permit and has noted that the lowest floor elevation for the proposed structure is in compliance with our flood plain zoning ordinance. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City hereby release the restriction on the issuance of a building permit for the subject lot. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Zimmerman and upon vote being taken thereon, the following voted in favor thereof: Mayor Gilbertson Councilmember Peterson Councilmember Zimmerman Councilmember Beyer Councilmember Hardin and the following voted against the same: None and the following abstained: None and the following were absent: None whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this the 13th day of October, 1992.
