Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION #92-10-255 RESOLUTION DENYING THE REQUEST BY DANIEL KARST, JR. FOR A CONDITIONAL USE PERMIT AMENDMENT TO EXPAND DANNY'S ALUMINUM PROCESSING, INC. WHEREAS, on March 25, 1991, Daniel Karst, Jr. of Danny's Aluminum Processing, Inc., applied for a conditional use permit amendment to allow an expansion of the Aluminum Processing Facility that would include disassembly of engines and transmissions; and WHEREAS, on April 11, 1991, the Planning and Zoning Commission conducted a public hearing and recommended that City Council approve the request for a conditional use permit amendment; and WHEREAS, subsequent to the April 11, 1991 Planning and Zoning Commission meeting, Daniel Karst, Jr. requested that his request for a conditional use permit amendment be tabled from City Council consideration until further notice; and W'HEREAS, in June, 1992, Mr. Daniel Karst, Jr., reactivated his request for a conditional use permit amendment which was revised to also include the capability to act as a redemption center for other non-hazardous metals and batteries; and WHEREAS, on September 1, 1992, the Planning and Zoning Commission conducted an additional public hearing regarding Daniel Karst, Jr.'s revised conditional use permit amendment and recommended City Council approval of same; and WItEREAS, on September 22, 1992, the City Council reviewed the request for a conditional use permit amendment, adopted Findings of Fact ~0322, and by motion voted to deny the request for a conditional use permit amendment; and WHEREAS, Section 9.03.04 of the Ramsey City Code requires that denials of requests for conditional use permits be accomplished by resolution. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: l) That the City Council denies, based on Findings of Fact #0322, the request by Daniel Karst, Jr. for a conditional use permit amendment to expand Danny's Aluminum Processing, Inc., to include disassembly of engines and transmissions and acceptance of other non-hazardous metals and batteries.
