Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-10-260 <br /> <br />RESOLUTION AUTHORIZING VACATION <br />BETWEEN PARCELS DESCRIBED AS PINS <br />31-0004 <br /> <br />OF STREET RIGHT-OF-WAYS <br />28-32-25-31-0003 AND 28-32-25- <br /> <br />WHEREAS, certain street right-of-way easements had been acquired by the City in 1977; <br /> <br />and <br /> <br /> WHEREAS, certain street easements are no longer necessary for use by the City and <br />public; and <br /> <br /> WHEREAS, the original need by the City for said easements has been replaced by other <br />easements which adequately address the City's requirements; and <br /> <br /> WHEREAS, the owners of parcels known as PINs 28-32-25-31-0003 and 28-32-25-31- <br />0004 have requested that the City vacate said easement; and <br /> <br /> WHEREAS, M.S.A. 412.851 entitled Vacation of Streets permits the City Council to <br />vacate public grounds and public ways; and <br /> <br /> WHEREAS, on October 6, 1992, the Planning and Zoning Commission held a public <br />hearing regarding the issue of vacating said easement between these lots, which public hearing was <br />preceded by two weeks public notice in the Anoka County Union and posted notice, and at which <br />public hearing all members of the public present were given the opportunity to be heard; and <br /> <br /> WHEREAS, after consideration of all relevant factors, the City Council finds that it is in <br />the best interest of the public to vacate said street right-of-way easements. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the street right-of-way easement legally described as follows is hereby vacated to wit: <br /> <br />An easement for road purposes 50 feet in width over that part of the Northeast <br />Quarter of the Southwest Quarter of Section 28, Township 32, Range 25, Anoka <br />County, Minnesota, the center line of which is described as follows: <br /> <br />Beginning at the point of intersection of the west line of said Northeast Quarter of <br />the Southwest Quarter with the southerly right of way line of the Burlington <br />Northern Railroad; thence southeasterly along the south right of way line of the said <br />Burlington Northern Railroad, a distance of 366.80 feet and to the actual point of <br />beginning of said center line; thence southwesterly to a point on the northerly right <br />of way line of U.S. Trunk Highway No. 10, said point being located a distance of <br />300 feet as measured along said right of way from the west line of the said <br />Northeast Quarter of the Southwest Quarter. <br /> <br />2) <br /> <br />That the City Administrator is hereby directed to prepare a Notice of Completion of the <br />Proceedings in conformance with M.S.A. 412.851. The City Administrator is then <br />directed to record the Notice of Completion with Anoka County to have said portion of <br />drainage easement removed from the title of said property. <br /> <br /> <br />
