I I I I I I I I I I I I I I I I I I I CouncilmeniberiPeterson introduced the following resolution and moved for its adoption: RESOLUTION #93-03-034 A RESOLiUTiON ADOPTING FINDINGS OF FACT JEANINE DUFF AND HOWARD TOWLE'S REQUEST USE PERMIT'FOR A PRIVATE DOG KENNEL. #0322 RELATING TO FOR A CONDITIONAL That Jeanine Duff and Howard Towle, hereinafter referred to as the "Applicants", have properly applied for a conditional use permit to maintain a private dog kennel for a maximum of ten (10) dogs. That the Applicant appeared before the Planning and Zoning Commission on February 2, 1993 for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 3. That the subject property is generally known as 16400 St. Francis Boulevard N.W. and is legaliy described as follows: Lot 1, Block 1, Duff and Towel Estates, Anoka County, Minnesota. That the subject parcel is approximately five acres in size. That the subject property is zoned R- 1 Rural Residential. Thai the surrounding parcels are also zoned R- 1 Rural Residential. Tha~ Section 9.02 of the Ramsey City Code defines dog kennel as any place where three or mlore dogs over three months of age are kept. 8. ThatCity Code regulations for the various zoning districts does not make provisions for dog kennels as permitted uses. 9. ThatlSecaion 9.20.11 of the Ramsey City Code states that no buildings housing animals may ,be within 75 feet of neighboring property lines. 10. Thatlthe proposed kennels are approximately 90 feet from the nearest property line. 11. Thatrthe Applicants have stated that no more than ten (10) dogs will be kept on the property. 12. That the Applicants have submitted building plans for an accessory structure and ten (10) kennel runs to accommodate the dogs. 13. That the Applicant has submitted a statement signed by six neighboring property owners stating their support of the request for the conditional use permit. 14. That ~ere are other similar permitted conditional uses in the City. 15. That the proposed use will not be hazardous or disturbing to existing or future neighboring uses.
