I I I I I I I I I I I I I I Councilme~ber Peterson introduced the following resolution and moved for its adoption: RESOLUTION #93-03-035 A RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT TO MAII~/~rAIN A PRIVATE DOG KENNEL ON THE PROPERTY LOCATED AT 16400 ST. FRANCIS BOULEVARD N.W. (P.I.N. 14-32-25-12-0013) W!IEREAS, the Ramsey City Council adopted Resolution #93-03-034 regarding Findings or,FaCt g0332 for this use and herein approves a conditional use permit subject to the following conditions: NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITy OF RAMSEYi ANOKA COUNTY, STATE OF MINNESOTA, as follows: On March 9;i 1993, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Jeanine Dhff and Howard Towle ("Permit Holder") to maintain a maximum of ten (10) dogs on the propertyi generally known as 16400 St. Francis Boulevard N.W. and legally described as follows: Lot 1, Block 1, Duff and Towel Estates, Anoka County, Minnesota. This permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this permit are as :follows: 1. This permit shall remain in effect so long as the conditions imposed herein are complied with. 2. A p~e~ent structure with attached kennel runs shall be constructed on the site as shown on the building plans submitted by the applicant and received by the City on January 12, 1993. At no time shall there be more than ten (10) dogs over the age of three (3) months maintained on the premises. If there are verified complaints of a noise or odor problem relating to the dogs, the permit holder shall be so notified by City Staff and shall thereafter immediately abate the nuisance. 5. Nodog under the ownership of the Permit Holder shall be allowed to run at large on the subject property, except under the direct supervision of the permit holder. 6. The kennel area shall be maintained in a sanitary condition according to State and local humane standards. 7. The permit holder shall not conduct a commercial boarding kennel or grooming business on the subject property. \ 8. The City Administrator or his designee shall have the right to inspect the premises for compliance purposes annually or at any time upon reasonable request. 9. The Permit holder shall be responsible for City co~ts incurred in administering and enfOrcing this conditional use permit. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Beyer and upoh vote being taken thereon, the following voted in favor thereof:
