Board M .~e~be~FDeemer introduced the following resolution and moved for its adoption: RESOLUTION //93-06-128 A RESOLUTION ADOPTING FINDINGS OF FACT g0341 RELATING TO A REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE NEARER [THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE ON THE PROPERTY GENERALLY KNOWN 17758 TONTO STREET N.W. WHEREAS, Steven Pfeiffer, hereinafter referred to as "Applicant!', has properly applied for a Boardiof Adjustment variance from Section 9.11.02 of the Ramsey City Code to construct an accessory fliu:age nearer the front property line than the principal structure on the property generally known as ~'~758 Tonto Street N.W. and legally described as follows: = Thai pm of Government Lot 1 and the Southwest Quarter of the Northeast Quarter of seeiion' 1, Township 32, Range 25 in Anoka County, Minnesota, described as follows: Co~mea)cing at a point on the east line of said Government Lot 1,' said point being a di.qtanc* of 980.6 feet south of the intersection of the east line of the Northeast Quarter of the ~ortheast Quarter of said Section 1 and the centerline of County State Aid Highway No. ~7 as it is now laid out and travelled, thence north 85 degrees 00 minutes west a. dis?race, of 800 feet, thence south 2 degrees 24 minutes east a distance of 335.85 feet to the poinl of'~beginning of land to be described; then continue south 2 degrees 24 minutes east on'the slime described line a distance of 123.68 feet, thence' south 79 degrees 36 minutes we$~a ~stance of 358.50 feet, thence south 1 degree 07 minutes 58 seconds east a distance of 32. For the purposes of this description, the east line of said government lot is assu~ex[ to bear south (subject to restrictions, NOW'THEREFORE~ BE IT RESOLVED BY THE BOARD OF ADJUST,~EI~ OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESO~TA~, as follows: That!the!,Applicant appeared before the Board of Adjustment for a public hearing pursuant to $~fio.n 9.03.05 of the Ramsey City Code on June 24, 1993 and that said pUblic hearing was l~ropt~fly advertised and that the minutes of said public hearing are hereby incorporated as a part'0f these findings by reference. That ~the ,subject property is zoned R-1 Rural Residential and is approximately 3.3 acres in size. That ihe aubject property is ~urrounded by R-1 Rural Residential zoning. That!Seotion 9.11.02 of the Ramsey City Code does not permit the construction of accea~o~, structures nearer the front property line than the principal structure. That [he principal structure on the subject property is located apprOximately 47 feet from the neareSst point on the front property line. That the Applicant is proposing to construct a 30' x 48' accessory garage approximately 20 feet.f~m!the nearest point on the front property line. That ~he Proposed size of the accessory structure is in'compliance with Section 9.11.02 of the R~.msey.: City Code.
