I <br />I <br />I <br />I <br />I <br />I <br />I$ <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> i$ <br /> <br /> Councilmem[~er Zimmerman introduced the following resolution and moved for its adoption: <br /> RESOLUTION g93-08-160 <br /> <br /> A RESOL~TiJON APPROVING THE ISSUANCE OF A CONDITIONAL USE <br /> PERMIT t~30~ AN ACCESSORY STRUCTURE LARGER THAN ALLOWED BY <br /> CITY CODE AND DECLARING TERMS OF SAME <br /> <br /> WItEREAS, Norman Archer has properly applied for a conditional use permit to <br />constmet an~ 4eee~sory structure larger than allowed by City Code on the property generally known <br />as 15410 Ja¢~el Street N.W. and legally described as follows <br /> Lot ?$ Block 9, Whispering Pines Estates, Anoka County, Minnesota; and <br /> WI-II~RgAS, the Planning and Zoning Commission met on August 3, 1993, conducted <br /> the public he&,-ing and recommended City Council-approval of the request. <br /> NoW~ TltEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF RAI~ISEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based onFindings of Fact g0342, a conditional use permit for an accessory structure larger <br /> than ~lloWed by City Code is hereby granted to Norman Archer, hereinafter referred to as <br /> "Penfiit Holder", at 15410 Jackel Street N.W., hereinafter referred to as the "Subject <br /> Proparty". <br /> <br />2. That this resolution shall allow for the construction of an accessory structure not to exceed <br /> 576 S~uaZe feet on the Subject Property and that the existing lean-to currently providing <br /> cove~r~ outside storage area shall be permanently removed from the property. <br /> <br />3. That the Permit Holder shall obtain all necessary permits prior to commencing any <br /> const/~u~ etlon of the accessory structure. The Permit Holder shall reimburse the City for all <br /> costs inc ~Urred in processing the request for a conditional use permit prior to the issuance of <br /> a buil~ng permit for said accessory structure. <br /> <br />4. That ~e accessory structure shall be built with the same type construction materials and <br /> shall hav¢ the same general design and exterior facing finish as that of the principal <br /> stm¢ ~tttre located on the parcel. <br /> <br />5. Tha~ the accessory structure shall be used for the storage of personal property and that no <br /> commercial or industrial activity of any type shall be permitted in said structure. <br /> <br />6. That ~he permit Holder and/or property owner shall be responsible for all City costs <br /> ineurr~l in administering and enforcing this conditional use permit. <br /> <br />7. That the City Administrator, or his/her designee, shall have the right to inspect the premises <br /> for eO~np~ance and safety purposes annually or at any time, upon reasonable request. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer and upon VOte being taken thereon, the following, voted, in favor thereof: <br /> Mayo~: James Gilbertson <br /> Coun6qlmember Sheila Beyer <br /> Councjlm~ tuber Kenneth Peterson <br /> Coun~ilmember Gerald Zimmerman <br /> Coun~ilmember Glen Hardin <br /> <br />and the following voted against the same: <br /> <br />None' <br /> <br /> <br />
