! <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />i <br />I <br />I <br />I <br />I <br /> <br />Board Mem[~r I~eemer introduced the following resolution and moved for its adoption: <br /> RESOLUTION #93-09-172 <br /> <br /> A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND <br /> DECLARING TERMS OF SAME <br /> <br /> WHI',REAS, James McChesney has properly applied for a variance to consu'uct an <br />accessory structure that will encroach on the C.S.A.H. #57 (Sunfish Lake Blvd. N.W.) <br />thoroughfarei and that will be nearer the front property line than the principal structure on the <br />property gen~rally known as 15429 Sunfish Lake Blvd. N.W. and legally described as follows: <br /> That part:of the Southwest Quarter of the Northwest Quarter of Section 23, Range 32, <br /> Town~hip, 25 described as follows: Commencing at the northeast comer of said Southwest <br /> Quarter of Northwest Quarter, then south on the east line a distance of 510 feet, then west <br /> and P ~arallel to the north line of the Southwest Quarter of Northwest Quarter a distance of <br /> 347 f~et to the center of town road, then north 20 degrees east on the centerline of said <br /> town ioad a distance of 544 feet to the north line thereof, then east on the north line of said <br /> SouthWest Quarter of Northwest Quarter a distance of 165.2 feet to the place of <br /> comn'/enCement (except that part platted as Anoka County Highway right-of-way No. 1 <br /> recor ~ded 7/16f74). <br /> WHF_;REAS, the Board of Adjustment met on September 7, 1993, conducted the public <br />hearing and }tdoPted findings of fact relating to the request to encroach on the 110 foot <br />thoroughfare getback for C.S.A.H. #57. <br /> <br /> NOW., THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMI~NT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, las follows: <br /> <br />1. BasediOn Findings of Fact ~g)344, a variance to construct a 25' x 30' accessory structure <br /> that w~l elacroach on the C.S.A.H. #57 thoroughfare setback and will be nearer the front <br /> property linc than thc principal structure is hereby granted. <br /> <br />2. The accessory structure shall maintain a minimum distance of ninety (90) feet from the <br /> centerl~ne Of C.S.A.H. #57. <br /> <br />3. This v~riance shall not apply to any future sanctum(s) placed on the property. <br /> <br />4. The property owner shall provide a survey to determine the south boundary of the subject <br /> properiy tO alleviate disputed boundaries, and if necessary will be granted a maximum <br /> varian~ of 5 feet from the setback requirement on the south property line for the purpose <br /> of con~tmoting the accessory structure. ' <br /> <br />5. The p~;opelrty owner shall obtain all necessary permits prior to commencing any <br /> construction. <br /> <br />6. The property owner herein agrees that no commercial activity shall be conducted from the <br /> accessory ~rucutre. <br /> <br /> <br />
