I I I I I I I I i I I I I Board Mem[~r I~eemer introduced the following resolution and moved for its adoption: RESOLUTION #93-09-172 A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING TERMS OF SAME WHI',REAS, James McChesney has properly applied for a variance to consu'uct an accessory structure that will encroach on the C.S.A.H. #57 (Sunfish Lake Blvd. N.W.) thoroughfarei and that will be nearer the front property line than the principal structure on the property gen~rally known as 15429 Sunfish Lake Blvd. N.W. and legally described as follows: That part:of the Southwest Quarter of the Northwest Quarter of Section 23, Range 32, Town~hip, 25 described as follows: Commencing at the northeast comer of said Southwest Quarter of Northwest Quarter, then south on the east line a distance of 510 feet, then west and P ~arallel to the north line of the Southwest Quarter of Northwest Quarter a distance of 347 f~et to the center of town road, then north 20 degrees east on the centerline of said town ioad a distance of 544 feet to the north line thereof, then east on the north line of said SouthWest Quarter of Northwest Quarter a distance of 165.2 feet to the place of comn'/enCement (except that part platted as Anoka County Highway right-of-way No. 1 recor ~ded 7/16f74). WHF_;REAS, the Board of Adjustment met on September 7, 1993, conducted the public hearing and }tdoPted findings of fact relating to the request to encroach on the 110 foot thoroughfare getback for C.S.A.H. #57. NOW., THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMI~NT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, las follows: 1. BasediOn Findings of Fact ~g)344, a variance to construct a 25' x 30' accessory structure that w~l elacroach on the C.S.A.H. #57 thoroughfare setback and will be nearer the front property linc than thc principal structure is hereby granted. 2. The accessory structure shall maintain a minimum distance of ninety (90) feet from the centerl~ne Of C.S.A.H. #57. 3. This v~riance shall not apply to any future sanctum(s) placed on the property. 4. The property owner shall provide a survey to determine the south boundary of the subject properiy tO alleviate disputed boundaries, and if necessary will be granted a maximum varian~ of 5 feet from the setback requirement on the south property line for the purpose of con~tmoting the accessory structure. ' 5. The p~;opelrty owner shall obtain all necessary permits prior to commencing any construction. 6. The property owner herein agrees that no commercial activity shall be conducted from the accessory ~rucutre.
