I$ I I I I I I I$ I I I I I I I Councilme ber!Peterson ~ntroduced the following resolution and moved for its adoption: RESOLUTION g93-09-219 A RESOI~UT!ON APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT~fFOR AN ACCESSORY APARTMENT IN A SINGLE FAMILY STRUCT~JREiIN THE R-1 RURAL RESIDENTIAL WHI~RI~AS, Curtiss and Blanche Titterud have properly applied for a conditional use permit (herei aafter referred to as "Permit") to maintain an accessory apartment within the single family dw01l nglin the R-1 Rural Residential District on the property generally known as 6865 162nd Lane l.W. and legally described as follows: That part. of the east half of the Northwest 'Quarter of Section 15, Township 32, Range 25, AnOl a County, Minnesota, described as follows: Commencing at a point on the West line of ti i east half of the Northwest Quarter a distance of 1,356 feet north of the Southwest corm: th.~reof. Then south 80 degrees 48 minutes east 80.61 feet then south 47 degrees 32 min~u es ~aSt 260.25 feet then south 5 degrees 11 minutes east 282.5 feet then north 89 degr¢ :s 38 minutes east 191.47 feet to actual point of beginning of tract to be described, then ~orth 0 degrees 22 minutes west 199.27 feet then north 40 degrees 1 minute 24 see¢ ds 0ast 222.56 feet to a point bearing south 49 degrees 58 minutes 36 seconds east 315.0 g f~t from a point 390 feet east of the west line and 175 feet south of the north line of the east half of the Northwest Quarter. WHI~REAS, the Planning and Zoning Commission met on September 7, 1993, conducted th6 public hearing and recommended City Council approval of the request. NoW; Ti-IEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAI~ISEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That ~aid~Permit shall remain in effect so long as the conditions imposed herein are comp~ed with and the Permit Holder retains ownership of the Subject Property. 3. That,the slructure exterior shall maintain the appearance of a single fam{!y dwelling unit. 4. That: the :structure shall not be sold as a duplex or the accessory apartment as a condo_CniniUm. 5. That ~e accessory apartment shall be restricted to a'one bedroom unit on the lower level of the str~ ctUre and is approved for occupancy by a maximum of tw° persons. 6. That ~ occupants of the dwelling and accessory apartment shall be provided with off-street parking. 7. That t,he P~ermit Holder herein agrees to absolve the City from any and all obligation associated. With the issuance of this conditional use permit as a result of the intensified use of th~ ~roPerty.
