I i/ I I I I I I I1 I I I I I I I I Councilm~ ber~fPeterson introduced the following resolution and moved for its adoption: RESOLUTION g93-10-256 A RESO_]~u'i~ION, BASED ON FINDINGS OF FACT //0349, APPROVING THE REQUE~ TO MAINTAIN A HORSE ON LESS THAN THREE (3) ACRES AND ~ I~ECLARING TERMS OF CONDITIONAL USE PERMIT W'H~$RI~A$, the Ramsey City Council adopted Resolution g93-10-255 adopting Findings of Fact g(}3~l~ f~ this use and herein approves a Conditional Use Permit subject to the following conditions:! NOW TIt~IE~ORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAM$~Y~( ANOKA COUNTY, STATE OF MINNESOTA, as follows: On October ~6,11993, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to'!~homas and Carrie Olson ("Permit Holder") to maintain a horse on the property generally lm~wn~as 15811 Okapi Street N.W. and legally described as follows: Lot 3~ Block 2, The North Forty 2nd Addition, Anoka County, Minnesota This permit !4 issped pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this permit are aa ~oll0ws: 1. i Thi.'s permit shall remain in effect so long as the conditions imposed herein are f coimplied with. A maximum of one (1) horse may be maintained on the subject property. Ttie mn-in shed that provides the animal with shelter is located less than 75 feet from_ property lines and is considered non-conforming. Any future reconstruction or ~new construction of an accessory building by Thomas or Carrie Olson that is intended to provide shelter for the animal, including a mn-in shed, shall be istmcted in accordance with City Code requirements at the time. In the event the ,se shelter has not been brought into compliance with City Code, it must be done so ppon a change of ownership in the property, if the new property owners intend to aaaintain a horse on the property. There shall be no exterior storage of horse related equipment and supplies. The stntcture used to provide this storage area shall have the same exterior facing finish ~as ~at of the principal structure on the property. Exterior storage of licensed horse wailers will be permitted. iTh{ ~!fence shall be maintained at a structural level adequate to contain the horses on ~the Property. Th~ Permittee shall expend reasonable efforts towards establishing and maintaining a tree screening along the side property lines adjacent to the fenced in pasture area. [ Con. centrated accumulations of manure shall be prohibited during the growing ~eason and winter accumulations shall be dispersed by May 1 of each year.
