Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> RESOLUTION 4/94-02-038 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0353 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION <br />ON THE *PROPERTY GENERALLY KNOWN AS 14450 BOWERS DRIVE N.W. <br /> <br /> WHEREAS, Robert and Susan Bowman, hereinafter referred to as "Applicants", have <br />properly applied for a Conditional Use Permit for a Home Occupation to establish and operate an <br />electronic aUtomobile equipment repair facility on the property generally known as 14450 Bowers <br />Drive N.Wo and legally described as follows: <br /> <br />CITY <br /> <br />Lot 32, BOWERS MISSISSIPPI ACRES, Anoka County, Minnesota. <br /> <br />NoW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />heating pursuant to Section 9.03.04 (Conditional Use Permits) and Section 9.11.04 (Home <br />Occupations) of the Ramsey City Code on February 1, 1994 and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these £mdings by reference. <br /> <br />6 <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately .8 acres in <br />size. <br /> <br />3. That commercial businesses are not a permitted use in the R-1 Rural Residential District. <br /> <br />4. That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />o <br /> <br />That the Applicant has provided documentation to support that the home occupation will be <br />conducted within the principal structure on the property and that the area set aside for the <br />home occupation is 1,118 square feet, which exceeds the maximum area (744 square feet) <br />allowed for a home occupation in this size structure by 50%. This is not in conformance <br />with :Section 9.11.04 (Home Occupations) of the Ramsey City Code. <br /> <br />Se <br /> <br />That more than one room will be utilized for the conditional use which is not in <br />conformance with Section 9.11.04 of the Ramsey City Code. <br /> <br />7. That the Applicant will reside at the location of the proposed home occupation. <br /> <br />That the Applicant has stated that the home occupation will not include any employment of <br />persons not residing in the private dwelling in the performance of the home occupation. <br /> <br />That the Applicant provides for storage needs in the attached garage and there is no exterior <br />storage of business equipment and materials <br /> <br />10. <br /> <br />That the proposed use will be unduly dangerous or otherwise detrimental to neighboring <br />residences. <br /> <br />11. <br /> <br />That the proposed use will substantially adversely impair the use, enjoyment or market <br />value of any surrounding property. <br /> <br /> <br />
