10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />That the addition contains its own kitchen, living room, bedroom, and bathroom, all of <br />whi0h are separated from the main living quarters by an atrium door, and its own furnace, <br />waVl~a' heater and gas meter, and is therefore considered to be an accessory apartment by <br />City?Staff. <br /> <br />That the Applicant has stated that the accessory apartment has been utilized as such ever <br />since it was constructed in the 1970's and the Applicant continued this use when taking <br />oWnership of the dwelling unit in 1991. <br /> <br />That, City Staff has determined that the homeowner responsible for constructing the <br />accessory apartment in the 1970's never properly obtained a conditional use permit in <br />accordance with City Code and therefore the accessory apartment is considered illegal non- <br />conforming. <br /> <br />That ithe main living quarters and accessory apartment were damaged by fh'e in 1993 and <br />upon~inspection by City Staff, the Applicant was informed that a conditional use permit <br />must ibc obtained to bring the accessory apartment into compliance with City Code. <br /> <br />That the Applicant has submitted a petition signed by four (4) neighboring residents <br />indicating no objection to the added living quarters. <br /> <br />That there are other similar permitted conditional uses in the single family district. <br /> <br />That the proposed use will not adversely impact traffic in the area. <br /> <br />That the proposed use will not be dangerous or detrimental to persons residing or working <br />in the vicinity. <br /> <br />That the proposed use will not substantially or adversely impair the use, enjoyment or <br />market value of surrounding properties. <br /> <br />That the proposed use will be maintained in order to be harmonious in appearance with the <br />existhag and intended character of the R-1 Rural Residential District. <br /> <br />That the proposed use will be adequately served by essential public services. <br /> <br />That the proposed use will not create excessive additional requirements at public cost for <br />public facilities and services. - ' <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor James Gflbertson <br />Coun~lmember Gerald Zimmerman <br />Counejlmember Sheila Beyer <br />Counc!lmember Kenneth Peterson <br /> <br />and the following voted against the same: <br /> Councilmcmber Glen Hardin <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br /> <br />
