10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that Anoka County constructed <br />improvements to C.S.A.H. #56 that included acquisition of additional right-of-way and <br />realignment of the roadway which diminished the front yard of the subject property. <br /> <br />That the special conditions causing the undue hardship do not result from the actions of the <br />Applicant. <br /> <br />That similar variances have been granted by the City in the Residential District. <br /> <br />That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />That such variance is necessary for the preservation of a substantial property right similar to <br />that possessed by other properties in the R-1 Rural Residential District. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br /> <br />That if granted, the variance will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the R- 1 Rural Residential District. <br /> <br />That if granted, the variance will not substantially increase the congestion of public streets, <br />or increase the danger of fire, or endanger the public safety, or substantially impair <br />property values within the neighborhood. <br /> <br />That the applied for use is not an expansion of the need for public services on the property. <br /> <br />That there is an ordinance on the table that would alleviate the need for a variance in this <br />particular case; this ordinance has been tabled by the Planning Commission pending <br />additional information from the Anoka County Transportation Department. <br /> <br />That the Subject Property has been recently surveyed by Anoka County as it relates to <br />upgrading Ramsey Boulevard (C.S.A.H. #56); hence the right-of-way is well-defined and <br />an additional Certificate of Survey is not necessary. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Terry and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Ben Deemer <br />Board Member Charles LaDue <br />Board Member Michael Terry <br />Board Member Paul Holland <br />Board Member Bradley Thorud <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />Board Member Terry Hendriksen <br /> <br />and the following were absent: <br /> <br />Board Member David Bawden <br /> <br /> <br />
