4 <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />That the principal structure on the subject property is located approximately 300 feet from <br />the ~ont property line and the proposed location for the accessory structure is <br />apprOximately 220 feet from the C.S.A.H. #57 right-of-way edge. <br /> <br />That construction of the accessory structure in a manner that meets the requirements of <br />SectiOn 9.11.02 is prohibited by an excessive front yard setback resulting from the <br />placement of the home, the location of the well, on-site septic system, alternate drainfield <br />area, and would require removal of a substantial amount of mature tree growth and the <br />addition of a substantial amount of fill. <br /> <br />That according to Section 9.11.02 (Accessory Uses) of the Ramsey City Code, the portion <br />of the subject property on which the accessory structure is proposed to be located is entitled <br />to a total of 3,664 square feet of garage and accessory building space. <br /> <br />That the total amount of accessory structure space currently existing on the property is 896 <br />square feet. <br /> <br />That the Applicant is proposing to construct an accessory structure 1,500 square feet in <br />size, which is in compliance with Section 9.11.02. <br /> <br />That there is a substantial amount of mature tree growth on the subject property that will <br />screen the proposed accessory structure from C.S.A.H. #57. <br /> <br />That the Applicant has stated that the variance requested is the minimum variance which <br />would alleviate the hardship. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that the builder of the home created a 300 <br />foot front yard setback by the placement of the home and the declining topography that <br />surrounds the location of the principal structure. <br /> <br />That the special conditions causing the undue hardship do not result from the actions of the <br />Applicant. <br /> <br />That such variance is necessary for the preservation of a substantial property right similar to <br />that possessed by other properties in the R- 1 Rural Residential District, namely the ability <br />to have accessory structures on the subject property in accordance with regulations <br />established in City Code. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br /> <br />That if granted, the variance will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the R- 1 Rural Residential District. <br /> <br />That if granted, the variance will not substantially increase the congestion of public streets, <br />or increase the danger of fire, or endanger the public safety, or substantially impair <br />property values within the neighborhood. <br /> <br />That the orientation of the principal structure is such that it appears to have been built with <br />Sunfish Lake Drive as the front yard; the City is in the process of acquiring Sunfish Lake <br />Drive as a public road. <br /> <br />19. That the City has granted similar variances within the past 12 months. <br /> <br /> <br />
