Board Member Terry introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #94-03-054 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND <br /> DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Lakeview Enterprises, Inc., has properly applied for a variance from the <br />side yard setback requirements in the B-3 Highway Business District and the impervious surface <br />area restrictions in the Critical River Overlay District on the property legally described as follows: <br /> <br /> Lot 3, Block 3, RIVERVIEW ESTATES, Anoka County, State of Minnesota <br />(the "Subject Property"); and <br /> <br /> WHEREAS, the Board of Adjustment met on March 17, 1994, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from side yard setback <br />requirements and impervious surface area restrictions. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0357, a variance to the side yard setback requirements and the <br />impervious surface area restriction is hereby granted. <br /> <br />The self-service storage facilities shall be allowed for development on the Subject Property <br />with a zero lot line configuration along the north property line. <br /> <br />The development of the Subject Property shall be allowed at an impervious surface area <br />limit not to exceed 88% of the lot area. Impervious surfaces shall include all structures and <br />surfaced driveways and parking areas. <br /> <br />The property owner shall manage all storm water runoff on and for the Subject Property in <br />accordance with the specifications and standards of the Department of Natural Resources, <br />the Environmental Quality Board, the Metropolitan Council and the City of Ramsey. <br /> <br />The property owner shall obtain all necessary permits prior to commencing any <br />construction. No building permit for the structures shall be released by the City of Ramsey <br />without certification of the variance by the Department of Natural Resources in accordance <br />with procedures established Section 9.21.07 (Critical River Overlay District Development <br />Standards) of the Ramsey City Code. <br /> <br />The property owner shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br /> <br /> <br />
