Board Member Terry introduced the following resolution and moved for its adoption: RESOLUTION #94-03-054 A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING TERMS OF SAME WHEREAS, Lakeview Enterprises, Inc., has properly applied for a variance from the side yard setback requirements in the B-3 Highway Business District and the impervious surface area restrictions in the Critical River Overlay District on the property legally described as follows: Lot 3, Block 3, RIVERVIEW ESTATES, Anoka County, State of Minnesota (the "Subject Property"); and WHEREAS, the Board of Adjustment met on March 17, 1994, conducted the public hearing and adopted findings of fact relating to the request for a variance from side yard setback requirements and impervious surface area restrictions. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact #0357, a variance to the side yard setback requirements and the impervious surface area restriction is hereby granted. The self-service storage facilities shall be allowed for development on the Subject Property with a zero lot line configuration along the north property line. The development of the Subject Property shall be allowed at an impervious surface area limit not to exceed 88% of the lot area. Impervious surfaces shall include all structures and surfaced driveways and parking areas. The property owner shall manage all storm water runoff on and for the Subject Property in accordance with the specifications and standards of the Department of Natural Resources, the Environmental Quality Board, the Metropolitan Council and the City of Ramsey. The property owner shall obtain all necessary permits prior to commencing any construction. No building permit for the structures shall be released by the City of Ramsey without certification of the variance by the Department of Natural Resources in accordance with procedures established Section 9.21.07 (Critical River Overlay District Development Standards) of the Ramsey City Code. The property owner shall be responsible for all City costs incurred in administering and enforcing this variance.
