11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />23. <br /> <br />24. <br /> <br />That the Applicant has properly applied for a variance to Section 9.21.07 (Critical River <br />Overlay District Development Standards). <br /> <br />That in 1986, a variance was granted for Lot 2, which is also in the Critical River Overlay <br />District, to be developed with an impervious surface area measuring 85% of the lot. <br /> <br />That .there are other similar permitted conditional uses in the B-3 Highway Business <br />DistriCt, specifically on Lots 1 and 2, Block 3, Riverside West. <br /> <br />That the City received a letter from Terry and Tara Goodwin, occupants and owners of the <br />adjacent residential property to the south, stating their support of the request. <br /> <br />That the proposed use will not adversely impact traffic in the area. <br /> <br />That the proposed use will not be dangerous or detrimental to persons residing or working <br />in theVicinity of the use or to the public welfare. <br /> <br />That the proposed use will not substantially or adversely impair the use, enjoyment or <br />market value of surrounding properties. <br /> <br />That the proposed use will be designed, constructed, operated and maintained so as to be <br />harmonious and appropriate in appearance with the existing or intended character of the <br />general vicinity and such use will not change the essential character of the area. <br /> <br />That the proposed use will be adequately served by essential public services. <br /> <br />That the proposed use will create additional requirements at public cost for public facilities <br />and services. <br /> <br />That the proposed use will not be detrimental to the economic welfare of the community. <br /> <br />That the proposed use will not be disturbing or hazardous to existing or future neighboring <br />uses. <br /> <br />That the proposed use will not involve uses, activities, processes, materials and equipment <br />and conditions of operation that may be detrimental to any persons, property or the general <br />welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. <br /> <br />That the proposed use will be in accordance with the objectives of the Comprehensive Plan <br />and the intent of Section 9.03,04 (Conditional Use Permits) of the City Code. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor James Gilbenson <br />Councilmember Gerald Zimmerman <br />Councilmember Sheila Beyer <br />Councillmember Kenneth Peterson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
