Councilmember Hardin introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #94-04-076 <br /> <br />A RESOLUTION ADOPTING FINDING <br />REQUEST FROM SIDNEY NYHUSMOEN <br />TO MINE AND EXPORTS SOILS <br /> <br />OF FACT #0360 RELATING TO A <br />FOR A CONDITIONAL USE PERMIT <br /> <br /> WHEREAS, the City of Ramscy received an application from Sidney Nyhusmoen for a <br />conditional use permit to mine and export soils from the property legally described as follows: <br /> <br />Lot 1, Block 1, HY-10 RAMSEY 4TH ADDITION, Anoka County, Minnesota. <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY,. ANOKA COUNTY, STATE OF MINNESOTA that the <br />findings of fact relating to the request are determined to be as follows: <br /> <br />That on March 15, 1994, Sidney Nyhusmoen, herein after referred to as "Applicant", has <br />properly applied for. a conditional use permit to mine and export soils in the I-1 Industrial <br />District. <br /> <br />That the applicant appeared before the Ramsey Planning and Zoning commission for a <br />public hearing pursuant to Section 9.03.04 of the City Code on April 5, 1994, and that said <br />publte hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. <br /> <br />o <br /> <br />That the subject property is located in the Industrial District, and is approximately 4.4 acres <br />in size. <br /> <br />4. That mining is not a permitted use in the Industrial District. <br /> <br />5. That the Subject Property is surrounded by Industrial zoning. <br /> <br />° <br /> <br />That the Applicant is proposing to strip the topsoil on the Subject Property, export <br />approximately 17,430 cubic yards of material, and replace the topsoil. <br /> <br />That no fill materials are proposed to be imported to the site. <br /> <br />8. That no blasting will be employed in the mining activity. <br /> <br />9. That no excavation will take place within the road right-of-way. <br /> <br />10. <br /> <br />11. <br /> <br />That the existing drainage patterns'will not be substantially altered by the proposed grading <br />plan. <br /> <br />That there are other similar conditional use pemfits that have been approved by the City. <br /> <br />12. <br /> <br />That the mining operation will increase the traffic to the subject property and surrounding <br />area. <br /> <br />13. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br /> <br />
