Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION #94-05-083 RESOLUTION AUTHORIZING ACQUISITION OF A CERTAIN PERMANENT PARK TRAIL EASEMENT BY USE OF MSA §117.011 AND §117.042 WHEREAS, the City has initiated a public project for the purpose of providing park trails from tlie City of Anoka/Ramsey boundary to the Ramsey Elementary School, which park trails are n~essary for the safety and convenience of the residents of the City; and WHEREAS, a permanent park trail easement is necessary and convenient for the furtherance of this project; and WHlgREAS, the City finds that the acquisition of a permanent park trail easement as described below will further the public health, safety and convenience of residents of the City; and WHEREAS, the City has the authority to acquire easement for said utilities by eminent domain pursuant to Minnesota Statutes § 117; and WHEREAS, the property owner from whom a permanent park trail easement is required has been identified by the City as follows: PIN FEE OWNER EASEMENT DESCRIPTION Daniel Laws A 30 foot wide parcel, said parcel being 15 feet on each side of the following described line. Commencing at the Southeast corner of the Northeast Quarter of Southeast Quarter of Section 26, Township 32, Range 25, Anoka County, Minnesota; thence on an assumed bearing of South 88 degrees 39 minutes 08 seconds West along the South line of said Northeast Quarter of the Southeast Quarter 112.92 feet to the point of beginning of the line to be described; thence North 28 degrees 59 minutes 55 seconds West 200 feet; thence North 16 degrees 00 minutes 05 seconds East 100 feet; thence North 28 degrees 59 minutes 55 seconds West 190 feet; thence North 03 degrees 09 minutes 10 seconds West 250 feet; thence North 26 degrees 50 minutes 50 seconds East 63 feet; thence North 03 degrees 09 minutes 10 seconds West 304 feet; thence North 30 degrees 39 minutes 00 seconds West 175 feet; thence North 60 degrees 39 minutes 00 seconds West 75 feet; thence North 30 degrees 39 minutes 00 seconds West a distance of 60 feet plus or minus to a point intersecting along the southerly line of the said Northeast Quarter of Section 26, and there terminating. AND WHEREAS, the City Council finds that it is in the City's best interest that the acquisition of ithe easement proceed as quickly as possible and therefore, the City needs to acquire possession of the necessary parcel prior to filing an award by the Court Appointed Commissioners; and WHEREAS, the City has the right to acquire easements prior to the ~iling of an award by the Court Appointed Commissioners, pursuant to Minnesota Statutes § 117.011 and § 117.042.
