Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #94-05-105 <br /> <br />RESOLUTION ESTABLISHING LAWFUL GAMBLING CONTRIBUTION <br />PERCENTAGE AS DEFINED IN RAMSEY CITY CODE CHAPTER 7, SECTION <br />7.61.09 ENTITLED USE OF LAWFUL GAMBLING NET PROFITS <br /> <br /> WHEREAS, MS Chapter 349.16, Subd 4 and 349.213, Subd. l(a) allow a statutory or <br />home rule charter city to require an organization conducting lawful gambling within its jurisdiction <br />to make an expenditure to the city, as a condition to operate within the city, provided that there <br />exists an ordinance requirement that such organizations must contribute a percentage, not to exceed <br />ten percent (10%), of net profits derived from lawful gambling to a fund administered and <br />regulated by the City without cost to such fund; and <br /> <br /> WHI~REAS, the City of Ramsey currently has in place Ordinance g94-05 which specifies <br />the requirements as outlined in MS Chapter 349; and <br /> <br /> WHgREAS, Ordinance//94-05 states that the contribution rate will be established from <br />time to time by Council resolution; and <br /> <br /> WHEREAS, it has been determined that three percent (3%) of net profits derived from <br />lawful gambling shall be the percentage that organizations will be required to contribute to a fund <br />administered and regulated by the City without cost to such fund. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNT, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the Ramsey City Council hereby establishes three percent (3%) of net profits derived <br />from lawful gambling shall be the percentage that organizations will be required to <br />contribute to a fund administered and regulated by the City without cost to such fund. <br /> <br />2) <br /> <br />That the effective date of such contribution requirement would be July 1, 1994 for all <br />lawful gambling activity conducted in the City. <br /> <br />3) <br /> <br />That Re Finance Officer is hereby authorized to enforce the contribution requirement and all <br />other areas of Ordinance g94-05 which administers and regulates lawful gambling activities <br />in the City. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gilbertson <br />Couneilmember Beyer <br />Couneilmember Zimmerman <br />Couneilmember Hardin <br />Couneilmember Peterson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
