11. <br /> <br />That on June 6, 1994, the Planning Commission was advised that DNR had denied the <br />permit request to fill a portion of Wetland ~#2-114P in order to construct Krypton Street <br />N.W. as a through street. <br /> <br />12. <br /> <br />That on June 6, 1994, the Planning Commission was also informed that bridging Wetland <br />#2-114P is a second alternative to constructing Krypton Street N.W. as a through street, <br />but it could adversely impact the City's opportunity'to obtain a permit to cross the wetlands <br />in that same proximity in order to extend Sunwood Drive as planned. <br /> <br />13. <br /> <br />That the Applicant has stated that bridging the wetland is cost prohibitive for the creation of <br />13 lots. <br /> <br />14. <br /> <br />That We special condition causingthe Undue hardship is the fact that the Subject Property is <br />surrounded on three sides by wetland and this condition does not result from the actions of <br />the ApPlicant. <br /> <br />15. <br /> <br />That by reason of physical conditions, namely Wetland #2-114P and County Ditch No. 43, <br />strict compliance with the requirements of cul-de-sac lengths will cause exceptional and <br />undue hardship to the development of the Subject Property. <br /> <br />16. <br /> <br />That if granted, the variance will not adversely affect the spirit and intent of the Ramsey <br />Zoning Chapter and Subdivision Design Standards. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor James Gilbertson <br />Councilmember Kenneth Peterson <br />Councilmember Sheila Beyer <br />Councilmember Gerald Zimmerman <br />Councilmember Glen Hardin <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br /> whereupon said resolution was declared duly adopted by the Ramsey City Council ~thjj. the 14th <br /> day of June, 1994.. .~/~2~'~' ~~~_ ~~~.~/> <br /> <br />('"-Gi~; ]["d'ministrator t <br /> <br /> <br />
