Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g94-06-133 <br /> <br />RESOLUTIiON RECEIVING PETITION COUNTERING <br />PROJECT ~94.15 (STREET LIGHT IMPROVEMENT FOR <br />ESTATES~ND ADDITION) <br /> <br />IMPROVEMENT <br />GREEN VALLEY <br /> <br /> WIlE!lEAS, on April 12, 1994, the City Council received a petition and ordered a <br />feasibility sturdy to consider the improvement of street lights to Green Valley Estates 2nd Addition <br />(Improvement;Project g94-15); and <br /> <br /> WIlE!lEAS, on May 24, 1994, the City Council conducted a public hearing for <br />Improvement project g94-15 at which several residents expressed opposition; and <br /> <br /> WHEREAS, in accordance with City Charter Chapter 8, Public Improvements and <br />Special AssesSments, the affected parties have 30 days to petition against said public improvement. <br />Such petition ~nust by signed by a percentage of affected owners greater than the percentage of <br />owners who signed the initiating petition; and <br /> <br /> wHEREAS, on June 9, 1994, the City received a petition countering Improvement <br />Project g94-15~; and <br /> <br /> WHEREAS, the City Administrator has found the petition to be of the correct percentage <br />of lawful sigtlatures of affected property owners, and to be in accordance with the City Charter and <br />Minnesota Statutes concerning local improvements. <br /> <br />NOW THER~EFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSE¥, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That a Certain petition countering Improvement Project g94-15 (the improvement of street <br />lights tO Green Valley Estates 2nd Addition) has been filed with the City Council on June <br />28, 1994. The petition is hereby declared to be signed by the required percentage of <br />affecte41 property owners. This declaration is made in conformity to City of Ramsey Code <br />Section. 4.60 and Minnesota Statute Chapter 429. <br /> <br />2) <br /> <br />That in accordance with City Charter Chapter 8, Public Improvements and Special <br />Assessments, the affected parties have 30 days (from the filing with the City Administrator <br />of the petition against Improvement Project g94-15) with which to file with the City <br />Administrator a petition in favor of the local improvement. Such petition must by signed <br />by a percentage of affected owners greater than the percentage of owners who signed the <br />petition against the public improvement. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Hardin and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gilbertson <br />Couneilmember Peterson <br />Counei!member Hardin <br />Councilmember Beyer <br />Councilmember Zimmerman <br /> <br /> <br />
