property described in paragraph 1 of this description; thence northerly along the easterly <br />line of said property forty (40) feet; thence southeasterly and parallel with said Highway 10 <br />to the easterly line of said Lot Three (3); thence southerly on said easterly line to the point <br />of beginning. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />o <br /> <br />o <br /> <br />0 <br /> <br />10. <br /> <br />12. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a <br />public hearing pursuant to Section 9.03.04 of the Ramsey City Code on July 5, <br />1994 and that said public hearing was properly advertised and that the minutes of <br />said public hearing are hereby incorporated by reference. <br /> <br />That the subject property is located in the B-3 Highway Business District and is <br />approximately 4 acres in size. <br /> <br />That the Applicant is proposing to place a 12' x 54' (648 square foot) portable <br />office structure on the subject property. <br /> <br />That the Applicant has stated that the purpose of the temporary structure is to <br />provide office space on the subject property until the fire damage to the principal <br />building that occurred on June 14, 1994 is repaired. <br /> <br />That utilization of temporary structures is not a permitted use in any zone in the City <br />of Ramsey without a special permit. <br /> <br />That the Applicant has stated that the temporary structure will be kept on the subject <br />property for approximately 6 months to allow sufficient time to reconstruct the <br />principal building. <br /> <br />That the properties to the south, west and east are also zoned B-3 Highway; the <br />property on the north side of the Burlington Northern railroad tracks is zoned <br />Business Warehous. <br /> <br />That the proposed temporary structure has already been located on the site and the <br />Applicant has deposited a $500.00 financial guarantee with the City to ensure timely <br />removal of the structure in the event the permit application is denied or upon the <br />expiration date of the permit. <br /> <br />That the proposed temporary structure will not increase traffic to or from the subject <br />property because it is not an enlargement of the facility but rather a temporary <br />replacement of existing office space lost in the fire. <br /> <br />That the proposed temporary structure will not be unduly dangerous or detrimental <br />to persons residing or working in the area. <br /> <br />That the proposed temporary structure will not impair the use of surrounding <br />properties. <br /> <br />That the proposed temporary structure will be maintained so as to be appropriate in <br />appearance with the character of the general area. <br /> <br /> <br />
