CASE # 1 <br /> <br />CONSIDER ADOPTION OF ORDINANCE AMENDING CITY CHARTER CHAPTER 8 <br /> AS RECOMMENDED BY THE CHARTER COMMISSION <br /> <br />By: William lC Goodrich, City Attorney <br /> <br />Background: <br /> <br />On May 22nd, the Charter Commission recommended an Ordinance to the City Council to amend <br />Chapter 8. of the City Charter. <br /> <br />The purpose of the proposed amendment is to limit the ability of owners of properties zoned for <br />commercial or industrial uses or owners of properties zoned residential greater than ten acres in size <br />to petition against public improvement special assessment projects. The Amendment also would <br />prohibit owners of non-homestead real property greater than one acre in size from petitioning <br />against such public improvement projects. <br /> <br />State Statute directs how the City Charter may be amended. One of the methods is that being <br />proposed by this Amendment. Upon recommendation of an ordinance by the Charter Commission, <br />the City Council shall hold a public hearing on the ordinance. If the Council adopts the ordinance <br />UNANIMOUSLY, it then is published as other City Ordinances. The ordinance is not effective <br />until 90 days after passage and publication. Within 60 days after passage and publication, a petition <br />requesting a referendum on the ordinance may be filed with the City Clerk. Such petition needs to <br />be signed by two percent (2%) of the total number of votes cast in the City at the last state election <br />or 2000 whichever is less. In the event a petition is filed, the ordinance will not become effective <br />until it is approved by the voters. There is other detail or an election which process will be further <br />explained if a petition is received. <br /> <br />City Council held a public hearing on June 13, 2006, to discuss the ordinance/Charter amendment. <br />There was no citizen input.
