Planting Distance from Utilities <br /> <br />1. Trees shall be planted a minimum of 2 feet from any joint utility <br /> trench whenever practicable. <br /> <br />k. Tree Preservation Tree Density Standard Calculation <br /> <br />All multi-family residential developments shall retain forty percent <br />(40%) of the inches of tree DBH existing on the lot after <br />subdivision. <br /> <br />If ir'cas in excess of sixty percent (60%) of desirable trees are <br />removed from the plat due to construction, they shall be replaced_, <br />on a one to one basis, in addition to the reouired plantinas <br />specified within the applicable zonina district, on a basis consistent <br />with thc tree cover requirements as outlined in the applicable <br />multi family residential zoning district. <br /> <br /> Subd. 9. Replacement of Trees. Developers shall be required to <br />maintain trees for one (l) year after the trees are planted. Should any tree require <br />replacement during this one (1) year period, the replacement period shall start at the date <br />of replacement. Except as provided herein, the rcplacemenr period shall not extend <br />beyond tx¥o (2) years from the original planting date. <br /> <br />The developer shall contact the City for a finaI inspection to be made <br />at the end of the replacement period. All trees not exhibiting a <br />healthy, vigorous growing condition, as dctermh~ed by thc City <br />inspection, shall bc replaced at the expense of the developer. <br /> <br />9.24.05 Hazardous and/or Nuisance Trees. The City shall have the fight to <br />cause the removal of any dead or diseased trees on private property within the City, when <br />such trees constitute a hazard to life and property, or harbor insects or disease which <br />constitute a potential threat to other trees within the city. In the event of failure of owners <br />to comply with such provisions, the City shall have the authority to remove such trees <br />and charge the cost of removal to the property owner. <br /> <br /> Subd. 1. Notice to Take Action. An order for a "Notice to Take <br />Action" will be issued upon determination by the City, or its designee, that maintenance <br />work requiring the pruning, preservation, or removal of trees or plants upon private <br />property when such action is necessary to insure public safety and/or to prevent the <br />spread of disease or insects to public trees and places. <br /> <br />138 <br /> <br /> <br />
